Library Granted Declaratory Judgment that its Weapons Policy is Valid, Lawful and Not Preempted by State Law
Today, the Ingham County Circuit Court entered a Declaratory Judgment in favor of the Capital Area District Library (CADL) declaring that its weapons policy is valid, lawful and not preempted by state law as claimed by the Michigan Open Carry attorneys. Judge Rosemarie Acquilina, the sitting circuit judge hearing the case also entered a permanent injunction against Members of Michigan Open Carry (MOC) or anyone else openly carrying firearms in any CADL branch library or property. Anyone violating the court order after being informed of the existence of the order may be held in contempt of court. One of CADLs attorneys, Gary Bender, said that CADLs goal is and continues to be to maintain a safe environment for children and adults who frequent the Capital Area District Library system. Last year there were over 1.5 million CADL visitors. We were very happy that Judge Aquilina after listening to the legal arguments of the attorneys ruled in favor of the banning of the open carrying of weapons in our libraries. We will take whatever lawful steps necessary to ensure visitor safety at CADL libraries. He also states, That includes enforcing the terms of the injunction with the contempt powers of the Court for anyone who violates it.
