On October 6, 2008 our client, thru their General Manager, MR. BERNARDINO D. CARAMBA, entered into a service agreement with your company for providing the required personnel to perform work for your Residential Beach Resort, for both resorts located in Nasugbu and Laurel, Batangas.

Our client has already sent you the summary of your statement of accounts last April 12, 2011, amounting to P 9,036,697.29, covering the period of October 2009 up to March 20, 2011. Attached herein as Annex A is the copy of the statement of accounts and its supporting computation. We hereby make our FIRST AND FINAL DEMAND from you to settle to our client the amount stated above as part of your obligation in the service agreement you signed together with our client. We hope to hear from you within TEN (10) days, upon receipt of this letter, for your reply. Failing to reply within the allotted period of days shall be considered as implicit refusal to indemnify our client and we shall be forced to file the necessary suit at the proper court of law. On the other hand, any refusal to do the above-mentioned demand of our client will constrain us to commence with a suit to protect the interest of our client. MARY NORGE ROSALES Vice President for Operations Canyon Woods/ Canyon Cove Re: Unpaid Accounts of Php 9,036,697.29 Dear Ms. Rosales: This has reference to the above subject referred by my Client, PRIMEPOWER MANPOWER SERVICES, for appropriate legal action. A demand letter dated April 12, 2011 was already sent to you on April 13, 2011, to date, you have no objection or question as to your accountabilities, which you are obliged to settle by virtue of the service agreement signed between you and my client. As a consequence, the amount of your liability is Correct and Final, which you are civilly liable. As a FINAL DEMAND, I am giving you Seventy-Two (72) hours from receipt hereof to settle your obligation. Should no positive result be taken after the lapse of the period given, legal action will proceed without further notice to protect the rights and interest of my client and hold you responsible for interest, penalties, attorneys fees, cost of suit and other consequential damages.
