AGREEMENT ENTERED INTO BETWEEN BEDOUIN INVESTMENTS CC AND ANEEQA ORRIE & ZUNAID KAPERY REGARDING SALE OF PROPERTY

BEING ERF NO. 43798 SITUATED AT NO.6 HEIFER ROAD RONDEBOSCH EAST WHEREBY

1) The Purchasers agree to effect all repairs carried out at the property for sale at their own cost and risk, with no financial implications on the Seller. 2) If the said works done exceeds the value of R50,000, this will have no financial implications on the Seller, nor will this affect the final agreed selling price of the property. 3) The Purchasers shall complete all repairs within the timeframe set out by the Seller being a 6 week period starting 15th November without inconvenience to the Seller and should also leave sufficient time constraints to satisfactorily repair any work that the bank rejects. 4) In the event of the Purchasers failing to complete the work to the standards required by the bank within the timeframe stipulated, the Seller shall, without prejudice, market the property to other prospective buyers. 5) The company carrying out the works should have full insurance and will be solely responsible/liable in the event of any accident or emergency incidents. 6) In the event of the transaction being cancelled by the Seller due to the Purchaser not meeting any of the suspensive conditions of the sale, the Purchasers shall have no claim against the Seller for the improvements made to the said property. 7) If the retention is not lifted by the financial institution upon registration/transfer, the Purchaser will be obliged to seek the R50,000 shortfall from another financial institution to cover the sale price of R925,000. 8) The Seller will be held fully responsible for expenses incurred up to R50,000 if the Seller wishes to cancel at any stage of the sale process.
