This agreement is between Melsharo Studios dba Scribbletime of 4115 Columbia Road #5-314, Augusta, GA 30907 (Photographer) and ____________ (collectively referred to as "Client") for the purposes of providing photography services.

Client Name: __________________ Phone Number & email ______________ 1. Scope of Work: Photographer shall provide photography session services for Client consisting of: _____________________ 2. Payment: Photographer shall provide photography session services describe above for the fee of $ 50% of the session amount is due by 8:00 pm EST ____to hold the date/time. (If payment is not received by deadline, then the session is not considered booked and the aforementioned date/time may no longer be available). Payment may be made via credit card using the following payment link: http://photos.scribbletime.com/payment (please note that Photographer will not have access to your credit card information)

3. Cancellation: On signing of this agreement by both parties hereto, Photographer will reserve time for agreed upon sessions and will not make another reservation for the specific time frame. The 50% payment required to ensure that Photographer will not schedule any other sessions for your date/time is non-refundable in case the event is cancelled for any reason. If Photographer cannot perform this Agreement in whole or in part due to a fire or other casualty, acts of God or nature or terror, or other cause beyond the control of the parties or due to Photographer's illness or injury, then Photographer will return any prepaid unused session fees to remit the Client but shall have no further liability with respect to this Agreement. Photographer cannot be liable for any amount above the agreed upon session price in the event of refund or dispute. This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost through camera malfunction, lost in the mail, or otherwise lost or damaged without fault on the part of Photographer. Client(s) must contact photographer in writing via USPS or email within 3 days upon receipt of products or digital images if items are damaged or quality does not meet client expectations. 4. Copyright Notice: This agreement constitutes an order for portraiture services, including the taking of event pictures as agreed to by both parties: Photographer and Client. Unless otherwise specified, it is understood that any and all rights to proofs, final or sample prints, thereof shall remain the property of the Photographer and may be used for advertising and marketing materials, display in professional portfolio or any other purpose thought proper by the Photographer. Any images displayed by client in electronic format on social media sites, blogs or client website must contain the following photo credit: "photo by: www.scribbletime.com" 5. Release: My Signature Below, and initials on attached pages, indicate my understanding and agreement to Scribbletime's Photography consent. (Read & Initial each statement below:)

I give consent for myself or minor child to be photographed by Scribbletime and give consent for Scribbletime to utilize images of myself or child in print and/or electronic publication for the purpose illustrating the photographer's professional ability. I understood that any and all rights to proofs, final or sample prints, thereof shall remain the property of the Scribbletime and may be used for advertising, display in professional portfolio, utilized in Scribbletime's printed or electronic publications or other purpose thought proper by the Photographer. I understand that I am held responsible for my own actions and the actions of any minor children for whom I am responsible during any Scribbletime photography session, and I hereby waive any right to legal action concerning events which stem from those actions. I agree to be held responsible for my own safety and the safety of each of my minor children during the session. On behalf of myself and such children, I hereby release the photographer, associates, subsidiaries, and assistants from all claims and liabilities of any kind. Client shall indemnify and hold harmless Photographer from any loss, damage or liability resulting from Client's violation of the terms of this Agreement or any agreement involving Client and the Photographer. Client shall indemnify Photographer and hold him harmless from and against any claim by any other person or entity resulting from the performance of his services under this agreement. 6. Additional Information: All edits are final. If you would like to request additional editing/retouching, a $25 per image additional processing fee will be assessed. Although not all editing requests are possible to achieve, additional editing my include: blemish/booger/bruise removal, teeth whitening, removing unwanted bulges, adding sun flare, adding wording to an image, adding artistic texture/touches to a particular image, etc. Scribbletime images are calibrated for specific professional labs and Scribbletime only guarantees the quality of products ordered through Scribbletime. All efforts will be made to correct defects for any products ordered through the gallery that arrive damaged or with a defect. Client must notify Scribbletime in writing of any product defect or problem within 3 days of receiving product. Scribbletime is not responsible for any product defect or quality of prints that are not ordered through the Scribbletime gallery lab. Our Guarantee & What We Cannot Guarantee: The age, mood and cooperation of children first and foremost determine a successful session, and we guarantee we will make every reasonable attempt to engage and get the best images of your child(ren) possible during the allotted session timeframe. However, we cannot guarantee that children will cooperate and engage fully in the session. If you feel the overall technical quality of your session's images does not match the technical quality of work in our portfolio, please notify us in writing within 3 days of viewing the images. We will be happy to address your concerns and provide a re-shoot if the request was received in the required timeframe . When the nature of the session does not allow for a re-shoot (such as a mini-session), the session fee will be refunded. Please note that in the event of a re-shoot, ALL the images from the original session will be destroyed and unavailable for purchase or further viewing. Additionally, use of destroyed images in any format is strictly prohibited.

I / we, the undersigned Contracting Party, hereby warrant that I am / we are competent to contract in my / our own name(s). I / we confirm that I / we have read the herein agreement prior to its execution and I / we are fully familiar with the contents thereof. This agreement shall be binding upon us and our heirs, legal representatives and assigns.
