The time is approximately 1046 hours. today's date is Tuesday, August the 9th, 2008.
Speaking is Detective Timothy Hightower. This'll be a statement in regards to Case #08-197. I
am currently in the parking lot of PRP High School, and currently in the car with Woody Cabbil
uh, Cabbil.

Hightower Uh, Woody, if you would, state your full name


for the tape..

Cabbil Woody Cabbil.

Hightower Okay. And spell your last name for me.

Hightower And Woody is a black male, and how old are

Hightower Okay. And what is your date of birth?

Cabbil Yes, sir.

Hightower Okay. And your home telephone number?

Hightower Okay. Woody, this statement is being tape-
recorded. Does this meet your approval?

Cabbil Yes, sir.

Hightower Okay. I'm taking this taped statement in


regards to the events that occurred on August
the 20th, 2008, that Wednesday...that occurred
during the PRP football practice. If you would,
please describe to me the events that occurred
on that Wednesday, August the 20th, 2008,
from the beginning of practice to the end of
practice.

Cabbil Like when, like when we started liftin'


weights?

Hightower Right.

Cabbil And then till the time we got on the field?

Hightower Right. Right...if you would, just go from that


day you started practice.

Cabbil Offense and de...the offense had to watch film


first and defense had to watch...had to lift
weights. then we rotated. Then after
everybody had watched the film, we went
outside to uh, practice and stuff. We had on
our helmets and shoulder pads on. Yeah, yeah.
We was doin' uh, we was doin' uh, we had, we

had done uh, individuals, then we go in to


team, then we got a drink of water. Then we
had to put on these skivvies, like to separate
defense from offense.

Hightower And what uh, what position do you play?

Cabbil Full back.

Hightower Okay.

Cabbil And we uh, I guess everybody was walkin' or


whatever. Then he told us to get on the line,
we started runnin' and stuff. We didn't have no
water breaks whenever, during the time we was
runnin'. We had water breaks before we was
runnin', but during the full, whole time we was
runnin', we didn't have not one water break.

Hightower Okay. So when you came outside uh, the


whole team came out of gettin', after you had
your film and that, so you came outside, your,
were you broken up in to two groups or one
group?

Cabbil Two groups.

Hightower And what group were you with?

Cabbil I was with the uhm, offense. The defense was


with defense.

Hightower Okay. And what did, what did y'all do then?

Cabbil We just did like, we did drills and stuff first.


Then we was about to go to team where
offense versus defense. But the defense was
puttin' on their skivvies, then he, I guess we

was takin' too long. He told us to get on the


line and made us run.

Hightower Okay. "Run". Okay. What, what did that


consist of? what were you running?

Cabbil We was running gassers, like think it's about 50


yards, like up and back, up and back.

Hightower Is that the whole field or half of the field?

Cabbil It's half of the field. We was runnin' sideways.

Hightower Sideways. Okay. so gassers uh, you ran those


up...what did they consist of, going all the way
across or just halfway?

Cabbil All, all the way across the field and back, and
then all the way across, then back.

Hightower So how many times did you do that to make


one gasser?

Cabbil Like up and back, then up and back, that's one.

Hightower So you gotta go four times...

Cabbil Yes, sir.

Hightower ...what you're tellin' me. That's one gasser. So


was everybody doin' it?

Cabbil Yes, sir.

Hightower Okay. And what, so how, how many of those


did you do?

Cabbil We did a lot, I think it was like uh...seemed

like we did about 18...18. Think.

Hightower Okay. So you did that and uh...

Cabbil i know it was, it was a lot.

Hightower It was a lot?

Cabbil Yes, sir.

Hightower How many water breaks were you


given...individually or as a team?

Cabbil Before we started runnin'?

Hightower Right.

Cabbil Like...

Hightower ...Or during practice, too? The whole time?

Cabbil The whole practice we pro'bly had about three


water breaks.

Hightower And was it given as a team or as individual?

Cabbil As a team.

Hightower Three?

Cabbil Yes, sir.

Hightower How many water breaks did you take on that


day?

Cabbil All three.

Hightower All three? After the last water break, what did

practice consist of?

Cabbil The running. We had came back from the


water break, then that's when we was about to
start the team practice, and then he told us get
on the line, we had to run.

Hightower And why was the team uh, running sprints?

Cabbil 'Cause he said we was walkin' so...

Hightower And how many sprints did you do as a group?

Cabbil 18. Everybody did the same amount. But


some people, they was so tired, they stopped.
they took a break for some, but the coach didn't
really see 'em do that.

Hightower So how many did you, your group take? Do?

Cabbil Our, the whole team was runnin' at once.

Hightower Okay. And that was 18?

Cabbil Yes, sir.

Hightower And you said...what group were you in?

Cabbil We, we wasn't in...we, we wasn't separate,


yeah.

Hightower As a team? You weren't sep...okay.

Cabbil We wasn't separated whenever we was runnin'.

Hightower How many sprints did you run before you took
off your gear?

Cabbil Let's see. Pro'bly about 12 or 13.

Hightower 12 or 13?

Cabbil Yes, sir.

Hightower And then after you took off your gear, how
many did you run?

Cabbil About four or five.

Hightower How long...

Cabbil (Inaudible).

Hightower Excuse me? I'm sorry.

Cabbil It was kinda more than that.

Hightower It was more than that?

Cabbil Yeah.

Hightower More than the four or the five?

Cabbil Yes.

Hightower How long do you think the team was running


sprints?

Cabbil About like, about like a hour...hour and 15


minutes.

Hightower Did you or any of your teammates ask for


water breaks or try to get water during the
running of the sprints?

Cabbil Not during the water, but after, after we had

got finished running, like he told us we was


gonna run till somebody had quit the team.
And like after, after uh, someone had quit, he
told us go get under the tree, and like a couple
of us tried to go get a drink of water, we got a
drink of water, then we was on our way back,
and he, he had seen us get a drink of
water...and he started yellin' at us, tellin' us, I
guess we wasn't in the spot where we was
supposed to be.

Hightower Okay. So uh, go back to this question...you


said that uh, you said some of your teammates
did try to get some water breaks, or did you
hear anybody ask for a water break?

Cabbil I heard like two or three people ask for a water


break.

Hightower Do you know who it was?

Cabbil Uh, no, I'm not sure, 'cause I was at the other
end.

Hightower You were at the other end. So you just heard


it...

Cabbil Yes, sir...

Hightower ...But you don't know who it was?

Cabbil No, sir.

Hightower And I need to ask while you were running the


sprints you heard somebody ask for water?

Cabbil Yeah, during, whenever we was running. Yes,


sir.

Hightower Running? Okay. But you don't know who it


was. And you said somethin' about the coach
said somethin' about he let y'all get some
water?

Cabbil No. After, after uh, after we had got finished


runnin', he told us go get under the tree, like
everybody go take a knee under the tree, but
we tried to go get some water. We got some
water like...it wasn't a whole team, it was a
couple of us. We got some water, we was on
our way walkin' back to, to get uh, under the
tree where everybody else was standin', then he
started yellin' at us for gettin' water, and stuff
like that.

Hightower and what happened then?

Cabbil nothin', he was just, he was just yellin'. Then


we had got under the tree. And he was talkin'
to us, he broke it down, everybody, everybody
walked in the uh, locker-room; walked back
towards the locker-room.

Hightower Okay. Did you see Max when...did you see


when he fell?

Cabbil Yes, sir.

Hightower What was, where were you at when you saw


him fall?

Cabbil Well, na...I was on like, like further down the


field, he collapsed.

Hightower Okay. You saw him collapse?

Cabbil Yes, sir.

Hightower What was he doin' when he collapsed? Did


you see him?

Cabbil Not, not really. Like when I got towards him,


they had picked him up and put him on the
uhm, whatever they was ridin' on. (Inaudible).
But...

Hightower Okay. So did you see him collapse?

Cabbil Yes, sir.

Hightower Okay. So what was he doing prior to him


collapsin'?

Cabbil Just layin' there. His eyes was, his eyes was
blinkin', I think.

Hightower Okay. Maybe I'm not makin' myself clear.

Hightower Okay. We're back on tape. I had to change the


tape over to Side B. The time is
approximately 1100 hours. I'm still continuing
the statement with Woody. Uh, Woody, if you
would, we go back to when you saw Max
collapse. I think that's where I left off at the,
on Side A. When you saw him collapse, where
were you at?

Cabbil Like further down the field from him.

Hightower Okay. And what was he doing when you saw

Max, just before he collapsed?

Cabbil He was bendin' over, kinda gaspin', he was


running, he was bending over, he was tryin' to
catch his breath.

Hightower Okay. He was trying to catch his breath. And


uh, he was bendin' over and then were you still
lookin' at him?

Cabbil No, 'cause we had got on the line, 'cause we


was about to run again. Then he, he had
collapsed.

Hightower Okay. And did, did anybody come over to help


him?

Cabbil the coaches had came over to give him


assistance.

Hightower Okay. And what did they do with him? When


you, what'd you see?

Cabbil They was pourin' water on his face.

Hightower Okay. They was pourin' water on his face?

Cabbil They called the ambulance.

Hightower And they called the ambulance? Okay. And


what were you doing? Were you still...

Cabbil I was tryin' to catch my breath, too, 'cause we


had been runnin' so much.

Hightower Okay. Alright. Did anybody else get sick that


you saw out there?

Cabbil Yeah, uh...

Hightower Before Max? Or after Max?

Cabbil Before. Another player, Antonio Calloway.

Hightower Antonio Calloway?

Cabbil Yes.

Hightower And what was he doin'?

Cabbil He was breathin' real hard, he had fell on the


ground, like he was just like, just his, his heart,
he was breathin' real fast and stuff, he had to
go to the hospital, too.

Hightower Okay. I'm gonna ask you this question again. I


can't remember if it was on tape or not, but
we'll go through it. During any practice this
year, have you personally seen or heard of any
teammates being injured?

Cabbil Like not big injuries like their ankles and stuff,
they'll tell the coach and the coach'll tell 'em go
put some ice on it, and stuff like that.

Hightower Okay. Those are the only injuries you're talkin'


about that you saw about the ankles?

Cabbil Like throwin' throughout the whole year?

Hightower Yes.

Cabbil Yes.

Hightower What about during practice? Any injuries?

Cabbil Not really. No, sir.

Hightower Okay. Do you know of anyone that has quit


the team?

Cabbil While we was runnin', David Englert quit the


team 'cause we was runnin' so much and stuff.

Hightower Okay. When did David uh, quit the team?

Cabbil Uhm, like we was runnin' and then uh, the


coach had came over there like towards,
towards my side, where I was standin' at,
'cause we was like, we was joggin', 'cause we
were so tired and stuff, and he had made us do
up-down's, 'cause we wasn't runnin' at our full
speed or whatever...then David, he, he made us
do up-down's, he told us to get in a circle and
we had to do up-down's. And David, I guess
he was tired, he told 'em that he quit. And then
Coach Stinson, he was like, okay. We got a
quitter, uh, y'all can stop runnin'.

Hightower Okay. And that was uh, when did that happen
on, did that happen on that Wednesday?

Cabbil On Wednesday. Yes, sir.

Hightower August the 20th? What about anybody else?


Do you know about anybody else quitting the
team?

Cabbil No, sir.

Hightower Has anyone influenced you in any way to


withhold information or change the facts that
occurred during that practice on Wednesday,
August the 20th? Did anybody influence you

Cabbil Like a little bit, Coach Stinson, he, he had told


us don't uh, don't speak to the media, if we,
they ask to interview us, uh, tell 'em, refer all
the questions to Coach Stinson.

Hightower Okay. So he told you all that?

Cabbil Yes, sir.

Hightower Did anybody else?

Cabbil Uh, no, sir.

Hightower Is this statement the truth?

Cabbil Yes, sir.
