RESUME
Monograph of A.V. Kopylov is dedicated to analysis of the institute of limited
proprietary rights for land existed in the Ancient Rome in historical-legal aspect,
i.e. from the point of view of its impact on legal doctrine and legislation of prerevolutionary, Soviet and modern Russia. Special accent in the essay has been
made on analysis of the perspectives of development of these rights within modern
Russian law and order, and necessity to introduce appropriate changes to current
legislation. Hereby SERVITUTES are reviewed firstly (being most ancient by
birth IUS IN RE ALIENA), then EMPHYTEUSIS is to be analyzed. Essay is
finished by researching the right of building (SUPERFICIES).
In the first chapter of the monograph conception, signs and certain kinds of
land servitutes existed in the Ancient Rome, as well as grounds for their
establishment and termination, and ways of protection are considered. When
researching servitutes' law of pre-revolutionary Russia author has concluded
that institute of land servitutes, came from Ancient Rome' law was, with no
doubt, much more known to the Russian civil legislation of that time period. At
the same time the lower level of the development of this institute is noticed, due
to both economic-geographical and juridical reasons. To sum up all said in the first
chapter of the essay, author has made a conclusion that private servitutes provided
by modern Russian civil law, came from Romanian SERVITUTES
PRAEDIORUM, underlying at the same time several important differences
between them (special grounds for establishment and refundable basis of Russian
servitute rights).
The second chapter of the essay is dedicated to history of beginnings,
conception, signs, grounds for establishment as well as instruments of protection
of EMPHYTEUSIS in Romanian law. Conclusion is made on that the development of the system IURA IN RE ALIENA in Rome led to beginnings of
EMPHYTEUSIS which had limited considerably competence of the owner in
comparison with servitutes. Analysis of chinch law in pre-revolutionary Russia Is
finished by the conclusion on origin of above mentioned institute from Romanian
EMPHYTEUSIS, as well as on its extraordinary vitality and applicability to
Russian conditions. To sum up all said in the second chapter of the essay,
author has made a conclusion on existence of political, economical and legal
preconditions in modern Russia for development of the right of lifelong
hereditable land possession - institute relatively close to EMPHYTEUSIS.

The third chapter of the monograph is dedicated to analysis of the history of

beginnings and development, conception and signs, grounds for establishment
and termination, as well as means of protection of SUPERFICIES in Romanian
private law. Author underlines that granting a building to the ownership as an
solitary property without appropriate land space was impossible in the Ancient
Rome; and the way had been found out in simultaneous burdening of both plot
and building stand on it by the limited proprietary right (SUPERFICIES) in
favour of the builder. Analysis of the right of building in pre-revolutionary
Russia allows to say that mentioned right had been being considered to be an
original proprietary law' institute, historically came from SUPERFICIES of
Ancient Rome. The essay is finished by the authors' conclusion on that in modern
Russian legislation the right of building is not an independent institute IURA IN
RE ALIENA, but does exist as a separate competence being included to the
content of other limited proprietary rights (lifelong hereditable possession and
permanent (without time-limit) use). At the same time author considers that in
modern Russia there do exist political, economical and legal preconditions for
restoration and development of the right of building as an independent IUS IN
RE, and suggests to introduce appropriate changes to the Russian legislation.
Attachments to the essay include rare legal acts from the history of Russian
civil law, regarding the institutes analyzed by the author.
