PREAMBLE We, the undergraduate Physics students of MSU Iligan Institute of Technology, aware of the constructive role of Physics

s in community development and nation building, bind ourselves in common aspiration to create a stronger alliance and cooperation among us to effectively channel our time and resources in promoting the learning of physics, do hereby ordain and promulgate this constitution.

ARTICLE I: NAME AND OFFICE SECTION 1. The organization shall be officially known as KAPISANAN NG MGA MAGAARAL SA PISIKA. The official acronym of the organization shall be KMP. SECTION 2. The principal office of this organization shall be located at the MSU-ILIGAN INSTITUTE OF TECHNOLOGY with the following address: KAPISANAN NG MGA MAG-AARAL SA PISIKA c/o Department of Physics College of Science and Mathematics MSU-Iligan Institute of Technology Tibanga, Iligan City, Philippines, 9200

ARTICLE II: NATURE AND PURPOSE SECTION 1. KMP shall be a non-profit, non-sectarian and non-partisan organization. SECTION 2. KMP shall establish and maintain contacts among its members and with other students, professionals and other organizations and shall provide an active and dynamic medium for exchange of ideas and experiences to improve and upgrade the knowledge in physics. SECTION 3. KMP shall develop a spirit of unity and camaraderie among the members of the organization and other individuals or parties by providing a venue for close interaction.

ARTICLE III: MEMBERS AND MEMBERSHIP SECTION 1. The organization renounces hazing and initiation ceremonies of any kind that will tend to degrade the dignity of the individual or discredit the good name of the Institute as a pre-requisite for membership. SECTION 2. Membership in the organizations is limited only to bona fide of the Physics Department of MSU-IIT. SECTION 3. Every member shall perform the task assigned by its officers for the interest of the organization and shall aid in the execution of projects and formation of polocies that will ensure that the objectives and goals of the organization shall be met. SECTION 4. Every member shall have the right to exercise his/her freedom, go against the task assigned to him/her that threatens the welfare of the organization, express his/her opinions and make suggestions that will further develop the organization. SECTION 5. The organization shall have a faculty adviser who must have a permanent status of appointment at the time of his designation and who shall serve for a term of one academic year without prejudice to re-appointment. ARTICLE IV: OFFICERS SECTION 1. The duly elected officers shall administer all affairs of the organization. SECTION 2. The set of officers for the organization shall composed of the President, Vice President, Secretary, Treasurer, Auditor, Public Information Officer and Year Level Representatives. SECTION 3. The President, Secretary, Treasurer, and Public Information Officer shall be sophomores at the time of election; and the Vice President and Auditor shall be freshmen at the time of election. SECTION 4. There shall be two Year Level Representatives in each year level. SECTION 5. All officers must have a grade a point average (GPA) of not lower than 2.25 as certified by the KMP Adviser, must be of good moral standing as certified by the Co-Chairman of the Student Discipline Board and a bona fide BS Physics of MSU-IIT.

SECTION 6. All elected officers shall assume office after taking their oaths of office. ARTICLE V: ELECTION AND DURATION OF TERMS SECTION 1. The organization shall hold two elections every year: 1.1 The election for the positions of President, Vice President, Secretary, Treasurer, Auditor, and Public Information Officer will be held within the month of March, the date to be determined by the incumbent president after due consultation with the Commission on Election. The election for the position of Year Level Representatives shall held during the month of June of the following Academic Year, the date to be determined by the incumbent president after due consultation with the Commission on Election.

SECTION 2. The KMP members shall nominate candidates for the position and voting shall be done by raising of hands. Whoever gets the highest number of votes shall be considered winner. SECTION 3. There shall be a COMELEC (Commission on Election) that will supervise the elections. The chairman of the Commission on Election shall be appointed by the KMP adviser before the election. Any member from the 3rd and 4th year may qualify. SECTION 4. The chairman of the COMELEC shall appoint the members of the COMELEC. SECTION 5. The COMELEC shall be composed of four members excluding the chairman, one from each year level. SECTION 6. The incumbent officers aside from the year level representatives shall not be allowed to hold the same position. SECTION 7. Newly elected officers shall be inducted into office before assuming office. SECTION 8. All officers shall hold office for one year or until their respective successors shall have been elected and inducted. SECTION 9. Special elections shall be held to fill any vacancy that may arise in the position of any officers due to illness, impeachment, or resignation, mental or physical

incapacity, and non-compliance of the provisions stated in Article IV, Section 5, except for the position of President. SECTION 10. In the event that a vacancy arises in the position of the President, the Vice President shall take over the functions of the President for the remainder of the latters term. ARTICLE VI: POWERS AND DUTIES OF OFFICERS SECTION 1. The President shall be chief executive officer of the organization. He/she shall: 1.1 Implement the recommendations passed by the Department of Student Affairs and College Executive Committee and assign tasks to ensure that the objectives and needs of the organization are met. Act as the official spokesperson of the organization or any instrumentality thereof, and thus represent of the organization at outside functions or meetings. Preside over all meetings of the organization. See to it that duties and functions of all officers and members are met. Submit a report of the state of the organization such as past activities in chronological order, financial condition and other matters concerning the organization to the Department of Student Affairs at the end of very semester. Call for emergency meetings as may be necessary. Perform other such functions as the Department of Student Affairs or College Executive Committee may, from the time, call him/her.

SECTION 2. The Vice President shall assist the President on all affairs of the organization. He/She shall: 2.1 2.2 2.3 Assume the responsibilities of the President in the latters absence. Advise the president on all matters of organizational policy and all affairs concerning the organizations. Perform other such functions as the President or the Department of Student Affairs may so direct.

SECTION 3. The Secretary shall be the principal administrative officer of the organization. He/She shall: 3.1 Take charge of the administrative affairs of the organization.

Prepare the agenda of the meetings of the organization after due consultation with the members and officers of the organization especially the President. Keep and maintain a directory of all members of the organization. Take attendance at all meetings and activities of the organization. Take the minutes of all meetings of the organization and shall furnish the organization copies of the minutes if they require so. Perform other such functions as the President or the Department of Student Affairs may so direct.

SECTION 4. The Treasurer shall spearhead the financial affairs of the organization ranging from the resource generation to resource allocation. He/She shall: 4.1 4.2 4.3 4.4 Secure the funds received and owned by the organization. Aid in overseeing fund-raising projects. Disburse funds for the needs and projects of the organization. Render a financial statement of the organization to the Department of Student Affairs and to the organization for auditing and publish reports on the expenditures of the organization with the approval of the President and the Faculty Adviser at the end of every semester. Preside over meetings on matters concerning financial issues. Inform the President and the organization of the financial status of the organization. Perform other such functions as the President or the Department of Student Affairs may so direct.

SECTION 5. The Auditor shall head the check and balance of the organizations funds. He/She shall: 5.1 5.2 5.3 5.4 5.5 5.6 Seek to ensure the honest handling of funds received and used by the organizations. Inspect the report made by the treasurer. Be given free access to all financial records of the organization. Investigate any discrepancies between the actual funds available and the financial records of the organization kept by the treasurer. Inform the President and the organization of the results of any such inspection or investigation. Perform other such functions as the President or the Department of Student Affairs may so direct.

SECTION 6. The Public Information Officer shall spearhead the publicity campaign and information dissemination of the organizations activities. He/She shall: 6.1 6.2 6.3 6.4 6.5 6.6 Spread information regarding the activities of the organization to all its members. Be responsible for the promotion of all activities and programs of the organization. Outline the organizations semestral activities for its members. Take charge of the bulletin board of the organization. Maintain contact or networking with affiliates. Perform other such functions as the President or the Department of Student Affairs may so direct.

SECTION 7. Each Year Level Representatives shall be the head of their respective year level. They shall: 7.1 7.2 7.3 7.4 7.5 Hear the voice of the members in their respective year levels whom they represent and voice it out in the board meetings. Conduct their own year level meetings in accordance with Article VII, Section 5. Collect contributions, if any, from each member and turn it over to the Treasurer. Help the Public Information Officer in disseminating information on matters involving the activities of the organization. Perform other functions as the President or the Department of Student Affairs may so direct. ARTICLE VII: MEETINGS SECTION 1. The organization shall have at least one general assembly per semester. SECTION 2. The President may call for emergency meetings as the need arises. SECTION 3. At least one-third of the members can also call for a special meeting. SECTION 4. For general meetings, fifty percent plus one of the total number of members shall constitute a quorum.

SECTION 5. The Year Level Representatives can organize their own meetings provided it has the consent of the President and the minutes thereof shall be submitted to the Secretary. ARTICLE VIII: IMPEACHMENT AND DISCIPLINE OF MEMBERS AND OFFICERS SECTION 1. Any officer of the organization may be impeached in the event that he/she: 1.1 1.2 Has grossly and deliberately violated this constitution. Has willfully neglected his/her duty and role as an officer.

SECTION 2. Any member may be removed from the organization in the event that he/she: 2.1 2.2 Has grossly and deliberately violated this constitution. Has willfully neglected his/her duty and role as an officer. ARTICLE IX: FINANCIAL REPORT SECTION 1. Grants, gifts and other monetary contributions not coming from illegal deeds such as stealing shall be accepted by organization. SECTION 2. The general membership must be called to a meeting for purposes of consultation and/or adopting proposed assessment fee and the corresponding budget proposal for the semester or school year, as the case may be. The adopted/approved budget shall be approved by the Department of Student Affairs before it is implemented. SECTION 3. The money collected and generated by the organization shall be deposited in MSU-IIT Multi Purpose Cooperative in the name of the organization with the President or Treasurer and Faculty Adviser as signatories to all withdrawals. SECTION 4. The incumbent Treasurer, and if necessary, the faculty adviser, before the end of their term and after the organizational election, shall transfer all accounts to the newly elected Treasurer and to the new club Adviser if the latter is newly designated. ARTICLE X: AMENDMENTS SECTION 1. This Constitution and By-Laws is subject to review shortly after every election.

SECTION 2. This Constitution and By-Laws may be amended or revised. SECTION 3. The President may call for a constitutional convention composed of the officers if deemed necessary. SECTION 4. All officers and members of the organization must be informed of the details of the amendments at most 15 days before start of the constitutional convention. SECTION 5. Amendments of the Constitution and By-Laws will become effective only after approval by the Director of Student Affairs and after ratification by the majority members of the organization. ARTICLE XI: EFFECTIVITY This Constitution and By-Laws of the Kapisanan ng mga Mag-aaral sa Pisika (KMP) will become effective only after approval by the Director of Student Affairs and after ratification by the majority members of the organization.
