A RESOLUTIONOF THE CITY OF PELICANBAY, TEXAS,TARRANTCOUNTY,

STATEOFiTEXAS,ESTABLISHINGRULESREGARDING THE USEOF EXCESSIVE
FORCEDURINGNONVIOLENT CIVILRIGHTSDEMONSTRATIONS.

WHEREAS,the City of PelicanBay, Texas, is a participantin the Texas CommunityDevelopment

Program(TCDP)anda recipient
of TCDPgrantfunds;and

WHEREAS,it is a conditionof the TCDPcontractbetweenthe Officeof RuralCommunityAffairsand the

Cityof PelicanBay,Texas,thata resolution rulesregarding
establishing the useof excessive
forceduring
nonviolent be passedduringthecontract
civilrightsdemonstrations period;and

WHEREAS,it is withinthe powerand properresponsibility

of government
to preventthe useof excessive
forceduringnonviolent
civilrightsdemonstrations;

NOW THEREFORE,
BE IT RESOLVED
BY THE CITY COUNCILOF THE CITY OF PELICANBAY,
TEXAS:

ARTICLEI
Section1:
That the City of Pelican Bay, Texas, adopts a policy of prohibitingthe use of excessiveforce by
the law enforcementagencieswithin its jurisdictionagainstany individualengagedin nonviolent
civil rights demonstration. The Cig also prohibitsthe physical barring of any entrance or exit of
such a facilityand will enforceallapplicablestatelaws regardingsame.

ARTICLEII
Section1:
Any personfound to be violatingany provisionsof this resolutionshall be servedby the City with
writtennoticestatingthe natureof the violation.

Section2:
Any person guilty of this violationshall be guilty of a misdemeanor,and on convictionthereof
shall be fined in the amount not exceedingone hundred dollars ($100.00)for each violation.
Each day in which any such violationshallcontinueshall be deemeda separateoffense.

Section3:
Any person violatingany of the provisionsof this resolutionshall become liableto the City for any
expense, loss, or damage occasionedthe City by reasonof such violation.
