FELIX CABATINGAN, Complainant, -versusRONNIE BALBUENA Accused. x-----------------------------------x COMPLAINT COMES NOW, the undersigned complainant, under oath, unto this Honorable Office, accuses RONNIE BALBUENA of whom a resident of Brgy. Panique, Aroroy, Masbate with the crime of ATTEMPED MURDER, committed as follows: That on March 18, 2013, about 2:00 oclock in the afternoon, at Barangay Panique, Aroroy, Masbate, Philippines and within the jurisdiction of this Honorable Office, the above-named accused, armed with bolo and with deliberate intent to kill and with evident premeditation, did then and there wilfully, unlawfully and feloniously attack, assault and stab twice, Felix Cabatingan, hitting on the different parts of his body, thereby inflicting wounds on different parts of his body, the accused thus commenced the commission of the felony directly by overt acts, but failed to perform all the acts of execution which would produce the crime of murder by reason of some causes other than his own spontaneous desistance.
