In Court of Judicial Magistrate Anjar-Kachchh

Mr. Sanjay Ajitsinh Koras Age:- 40 Years Add:- SDX North-20, 2nd Floor, Chawla Chowk. Gandhidham, Kachchh V/S 1. Mr. Mukesh Nihalsingh Jaat Add:- Muradpur, Thana Singhana, Zunzun Dist, Rajasthan. 2. Rajeshbhai

I complainant Mr. Sanjay Ajitsinh Koras doing job as branch in-charge at North Eastern Carrying Corporation Ltd. Our company got work of transporting oil container and Tin etc of M/s Kargil India Pvt Ltd from Bhimasar-Kachchh to its Kargil depot at Ludhiana. So our company gave contract of transporting same to M/s Akshay Roadlines through their vehicles on which in-charge of M/s Akshay Roadlines Mr. Rajeshbhai (09978533233) sent truck registration number HR-61-5880 to Bhimasar and driver was Mr. Mukesh Nihalsingh Jaat. On 11/08/2012 driver Mr. Mukesh loading 1084 pieces of different oil containers and tins from Kargil India Pvt Ltd started to transport it, on his way on 14/08/2012 when truck of Mr. Mukesh reached at Dahina Thana Ravol, Dist-Rewadi at that time truck suddenly rolled down as per driver Mr. Mukesh for which driver Mr. Mukesh did Janva Jog in police station at Dahina Thana Ravol, Dist-Rewadi, but the cause of accident which driver Mr. Mukesh is showing is unbelievable because no such heavy vehicle rolled down itself without having accident with any other vehicle so we have doubt that driver Mr. Mukesh due to his fault made truck

rolled down, but driver Mr. Mukesh did not mentioned anywhere in Janva Jog entry about damages done to goods in truck. After that on 22/08/2012 truck reached at Kargil Depot, Hussainpur village, Ludhiana. Then our company was informed that from 1084 pieces sent, the purchaser got only 591.5 pieces about which driver Mr. Mukesh was informed at same time by concerned person over there, but driver Mr. Mukesh did not informed us any such matter so our company came to know about same right now that purchaser got only 591.5 pieces from 1084 pieces sent by us. So we informed same about in-charge of M/s Akshay Roadlines Mr. Rajesh and driver Mr. Mukesh but they always used to give excuses and are not giving proper clarification about goods lost. So it is complain against Mr. Rajesh and driver Mr. Mukesh for doing fraud with us and we are requesting to police to take legal actions against them under CRPC Penal-156(3).
