Is a foreclosure proceeding taking place? Is the lien just a claim against the land?

Should the EPA be allowed to place a lien against the property for cleaning it u p? They did incur the costs? The toxins were a public threat? What are and were the Reardon's responsibilities? Federal Government can put a lien on any person or entity for being liable to th e United States. Due process could not be applied against Federal Liens. But thi s kind of lien process need to be notified before actual lien process so that th e person or entity will get sufficient time to respond for the allegation made. Assuming for a moment that EPA intervened in this issue and just issued a notice to cleanup the environment with in certain time limit, they might have done on their own. Actually if we look at the case Reardons' paid for the cleanup in 198 7. EPA intervention removes dangerous situation of toxins not getting cleaned qu ickly which might have been much more dangerous to environment and also to Reard ons'. 42 U.S.C. 9607(l) states: All costs and damages for which a person is liable to the United States under su bsection (a) of this section . . . shall constitute a lien in favor of the Unite d States upon all real property and rights to such property which (A) belong to such person; and (B) are subject to or affected by a removal or remedial action. (2) Duration The lien imposed by this subsection shall arise at the later of the following: (A) The time costs are first incurred by the United States with respect to a res ponse action under this chapter. (B) The time that the personreferred to in paragraph (1) is provided (by certifi ed or registered mail) written notice of potential liability.
