All parties announced ready and this cause proceeded to trial. At the conclusion of the evidence, the Court submitted the case to the jury. After deliberation, the jury reached a verdict, which the Court accepted. Upon consideration of the jury’s verdict, all post-verdict motions and briefs which have been filed by the parties, and the arguments of all counsel, the Court finds that judgment should be entered as set forth herein. FINAL JUDGMENT Page 160345 IT IS ORDERED, ADJUDGED and DECREED that Anthony Alardin have and recover judgment against Gregg Hoss in the amount of $2,822,519.00, representing the $3,000,000.00 in damages found by the jury in response to Question 18.a of the Court’s Charge, less $177,481.00 found by the jury as the amount owed to Gregg Hoss by Anthony Alardin in response to Question 9 of the Court’s Charge. Post-judgment interest shall accrue on the foregoing amount at the rate of 6.00% per annum from the date this judgment is entered until it is paid. IT IS FURTHER ORDERED, ADJUDGED and DECREED that Gregg Hoss have and recover judgment against Anthony Alardin in the amount of $117,481.00, against SiteWatch LLC d/b/a SiteWatch Systems in the amount of $36,631.00, and against Alardin Development Corporation d/b/a Remote Monitoring Technologies in the amount of $27,998.00. Gregg Hoss shall have and recover judgment for his taxable court costs incurred herein from SiteWatch LLC d/b/a SiteWatch Systems and from Alardin Development Corporation d/b/a/ Remote Monitoring Technologies, jointly and severally. Post-judgment interest shall accrue on the foregoing amounts at the rate of 6.00% per annum from the time this judgment is entered until itis paid. IT IS FURTHER ORDERED, ADJUDGED and DECREED that Gregg Hoss have and recover judgment from Anthony Alardin, SiteWatch LLC d/b/a SiteWatch Systems and Alardin Development Corporation d/b/a Remote Monitoring Technologies, jointly and severally, the amount of $500,000.00. Post-judgment interest shall accrue on the foregoing amount at the rate of 6.00% per annum from the time this judgment is entered until itis paid. IT IS FURTHER ORDERED, ADJUSDGED AND DECREED that in the event of an appeal contesting the relief awarded herein to Gregg Hoss, Gregg Hoss shall have recover judgment, jointly and severally, from the parties, Anthony Alardin, SiteWatch LLC d/bla SiteWatch Systems and Alardin Development Corporation d/b/a Remote Monitoring ‘Technologies, who join in said appeal the additional sum of $100,000.00 for an appeal to the FINAL JUDGMENT Page 200346 Court of Appeals of relief granted to Gregg Hoss herein if Gregg Hoss prevails on the relief herein granted him after all appeals are final, and the additional sum of $50,000.00 for an appeal to the Supreme Court of relief granted to Gregg Hoss if Gregg Hoss prevails on the relief herein granted him after all appeals are final. IT IS FURTHER ORDERED, ADJUDGED and DECREED that Angela Hoss, Hoss Equipment Company, and Nyle Brasch take nothing on any of their respective claims or causes of action against Anthony Alardin, SiteWatch LLC d/b/a SiteWatch Systems, and Alardin Development Corporation d/b/a Remote Monitoring Technologies. Anthony Alardin, SiteWatch LLC d/b/a SiteWatch Systems, and Alardin Development Corporation d/b/a Remote Monitoring Technologies shall have and recover judgment for their taxable court costs incurred herein from Angela Hoss and Nyle Brasch. IT IS FURTHER ORDERED, ADJUDGED and DECREED that Anthony Alardin, SiteWatch LLC d/b/a SiteWatch Systems, and Alardin Development Corporation d/b/a Remote Monitoring Technologies take nothing on their claims or causes of action for conversion and/or theft of property as against Gregg Hoss, Hoss Equipment Company, and Hoss Equipment Nevada, Inc. Hoss Equipment Nevada, Inc. shall have and recover judgment for its taxable court costs incurred herein from Anthony Alardin, SiteWatch LLC d/b/a SiteWatch Systems, and Alardin Development Corporation d/b/a Remote Monitoring Technologies. IT IS FURTHER ORDERED, ADJUDGED and DECREED that all writs and processes needed for the enforcement and collection of this judgment shall issue as many and often as necessary.
