The New York State Board of Elections is forwarding to you the attached names and addresses of candidates and
treasurers of political committees who failed to make one or more of the financial disclosure filings that were due
between January 15, 2008, and October 24, 2008. See Election Law Section 14-100 et seq. In light of the Board's
extensive efforts to obtain compliance, including bringing an Order to Show Cause and obtaining a Judgment to
mandate filing, the Board considers each continuing failure to file to be knowing and willful. Election Law § Ld
108(5) establishes a standard of prima facie evidence of knowing and willful failure to file under the initial notice
process mandated of, and utilized by, the Board,

126(2)
