COMMONWEALTH’S STATEMENT OF THE CASE
Now comes the Commonwealth in the above captioned matter and submits this
statement of the case. This statement is provided to assist the court and is not intended to
be a bill of particulars nor does it contain all information known to the Commonwealth at
this time.
‘At 4:48 pm on May 18, 2009, Harvard University police received a call reporting
shots fired in the area of the “J” entrance to the Kirkland House dormitory at Harvard
University. At approximately 4:50 pm on May 18, 2009, Cambridge Police Officer Brian
‘Mushlin was dispatched to the comer of Dunster St. and Mt. Aubum St. in Cambridge,
fora report of @ shooting. On arrival, he found the victim, later identified as Justin Cosby
of Cambridge, largely incoherent but reporting that he had been shot. Cosby was bleeding.
from what appeared to be a gunshot wound to the abdomen. Cosby was transported to
Beth Israel Deaconess hospital, where he later died. A trail of blood fed down Dunster
St. toward the area where the shots were reported. A bloody work shirt with a Sunoco
Jogo was found near the victim. Wrapped in that shirt was approximately four ounces of
a green leafy substance believed by police officers to be marijuana.‘Though the victim had his cellular phone on his person immediately prior t0 his
being shot, and made call from that phone, when the victim's clothing and personal
effects were examined at the hospital, no cell phone was found an the vietim, nor was any
phone recovered from the scene of the shooting. Records corresponding to the victim's
cellular telephone revealed that he had made severa) calls immediately prior to bis being
shot and officers traced the phone number Cosby had called to Jabrai Jordan Capney,
New York resident who frequently visited the Harvard campus, and was known to be on
campus on the day of the shooting. Cambridge and State Police developed information
that Copney had arranged to buy marijuana from Justin Cosby that day.
'At the time of scheduled drug purchase, the defendant was accompanied by two
other males, at least one of whom had arrived from New York that same day. One of
these individuals was identified through police investigation as Blayn Jiggetts of New
York. Jiggetts has been charged with Murder in the Cambridge Distriet Court, and has
refused to waive rendition from New York at this time. Jiggetts and Copney were both
determined to have fled the state immediately after the murder took place.
Police investigation discovered that Jabrai Jordan Copney had indicated to 2
witness that the marijuana purchase was arranged 10 take place in the basement of
Kirkland House. Subsequent police investigation revealed that Copney and Tiggetts
never intended to pay for the marijuana, and instead intended to rob Cosby. That same
investigation revealed that Copney had been observed leaving the “I” entryway
immediately after the sound of shots being fired, and that he was earrying a pisto) in his
‘hand at the time. A gun was later recovered which police were able to determine had.
been in the possession of Jabrai Jordan Copney immediately after the murder, That gun,2.9 mm semiautomatic pistol, was the same caliber as casings found at the scene close.
‘Also recovered was a jacket that was identified as worn by Copney that same day was
recovered by police. State Police chemi:
sts subsequently tested the defendant’s jacket and
found that it tested positive for gunshot residue.
