CONSENT INJUNCTION
Pursuant to the parties’ agreement at a hearing held on July 2, 2008, the Court hereby
ENTERS this consent injunction:
- It is ORDERED that no party shall destroy or alter any evidence in his or its
possession or control that relates to the traffic stop and arrest of Plaintiff Keith
Wayne Schmidt on or about May 22, 2006, including but not limited to any video
recordings from dashboard-mounted video cameras depicting Plaintiff during that
stop and arrest;
- It is further ORDERED that each party shall take all necessary and practicable
steps to locate and preserve such evidence, whether or not that evidence is in the
possession or control of the party, his or its employees, or his or its agents, as,
soon as he or it becomes aware of the existence of such evidence; and
= It is further ORDERED that all obligations relating to the preservation of
evidence imposed by the Court’s Temporary Restraining Order of May 29, 2008
Doc. No. 6) that are not otherwise imposed here, if any, are hereby imposed
against all parties.
