Civil Advocacy: Part 36 Submission on Costs After Judgment

V/O "Judgment has just been awarded to the Claimant in the trial of a building dispute. The judgment sum is 14,875.84. Counsel for the Defendant has just provided the judge with a copy of the without-prejudice correspondence containing the offer, and now makes a submission on costs to the judge." Counsel Your Honour, as you can see on the 16th of August last year the defendant made an offer of settlement within the terms of Part 36 of 15,000. The relevant period, attached to that offer was 21 days the last day of which was the 6th of September. The claimant has not succeeded in obtaining judgement more advantageous than the offer and I therefore ask for the defendants costs, with interest from the 7th of September pursuant to CPR Rule 36, 14 2.
