The above referenced case was referred to this Office on
June 13, 1994. On July 28, 1994, the undersigned issued a
Notification of Receipt of Request for Hearing and Prehearing
Order which required the parties to exchange and submit
information relative to their positions in this matter. By
letter dated August 22, 1994, Complainant informs the undersigned
that Respondent agrees to reinstate the full amount of grant
monies at issue in this case. As such, Complainant requests that
its appeal be withdrawn.
Accordingly, it is ORDERED that Complainant's request to
withdraw its appeal is granted and this case is hereby DISMISSED.
