Subject: Written Warning (1st Offense)

1. The purpose of this memorandum is to provide you a written


warning with regard to the unacceptable behavior you
demonstrated on 11/03/2009. One the above date after briefing the
guard section last of the entire RT section, on a reminder and that
their individual negligence would not become my emergency.
Immediately you stayed after all left and you were observed by
myself, Duane Haun, and Tim Trapanier as you made the statement
that “you and I were going to have a problem” that if for example
time cards could not be completed on time do to internet problems
and I stated “just let your boss know about it, and there would not
be a problem”, you were the only one that seemed to not
understand. This is a violation of section F. Standards of Conduct
section of the Employee Manual, letter h) Threatening, intimidating
or coercing fellow employees on or off the premises- at any time, for
any purpose. You have already received a verbal warning on
11/03/2009 with regard to this unacceptable behavior.

2. In accordance with the TATE Employee Manual Threatening,


intimidating or coercing fellow employees on or off the premises- at
any time, for any purpose is not acceptable. Continued behavior of
this nature may result in further admonishments that may include
fines, suspensions or other measures deemed appropriate to the
circumstances.

3. In keeping with TATE Inc. policy you have a right to provide an


explanation of the circumstances or a rebuttal of your supervisor’s
opinion of this incident. If you choose to provide such an
explanation please attach a copy of it to this memorandum. A copy
of this warning along with your explanation/rebuttal will be
maintained in your personnel file.

4. You are warned that further unacceptable behavior will not be


tolerated and you are encouraged to adhere to the Standards of
Conduct section of the Employee Manual.
