Religious Conference Not a Priority for South

- was a bit amused to read in a pro.-slami( website that /udan is hosting an
international (on0eren(e to bring an understanding between Muslims and *hristians.
-n theory, it1s a good idea to hold su(h a gathering. 2ut it will be a waste o0 time,
energy and resour(es i0 the (on0eren(e turns out to be a tal' show, or a plat0orm to
blame some imaginary ad)ersaries su(h as (olonialism, imperialism or the Great
/atan Ameri(a 0or the (haos in the -slami( world.
More than 3 years a0ter independen(e northern /udanese still blame 2ritain e4(ept
themsel)es 0or /udan 1s woes. They also attribute the (risis in 5ar0ur , whi(h is
(learly a lo(al problem, to imperialist and 6ionist (onspira(ies. They need to grow up.
Reading between the lines one is le0t without a shadow o0 doubt that the -slamists will
dri)e the agenda o0 the (on0eren(e, s(heduled 0or 7une &&.&3 in ,hartoum , under the
theme 81/ustainability o0 Pea(e and *onsolidation o0 9ational :nity11. The pro.
-slami( website named the organisers as the Ministry o0 Guidan(e and ;ndowment,
that narrow.minded institution that single.handedly destroyed 0aith in /udan 1s unity
by promoting one religion, in (ollaboration with the toothless /udan -nter.Religious
*oun(il and the Arab Thought <orum, (haired by Prin(e Al.Hassan bin Talal o0
7ordan.
-t appears the -slamists are organising the (on0eren(e to polish their image as well as
to rein)ent themsel)es. They will dis(uss the deteriorating relations between
*hristians and Muslims globally. -n the pro(ess, they will try, as usual, to portray
themsel)es as a )i(tim o0 global (onspira(y.
The -slami( website said the gathering 81aims at holding a s(ienti0i( and ob=e(ti)e
dialogue with an aim to rea(hing a (ommon understanding and shared ground > to
deepen the relationship and (o.e4isten(e between the 0ollowers o0 -slam and
*hristianity > and promoting the role o0 mos?ues and (hur(hes in (o.e4isten(e and
dis(arding o0 religious 0anati(ism and e4tremism11.

/ometimes the -slamists thin' we li)e on another planet. -0 only they, along with the
rest o0 the northerners, were to uphold those )alues listed abo)e there wouldn1t ha)e
been a need 0or su(h a (ostly gathering. We would be li)ing pea(e0ully now. And

That hasn1t happened. The -slamists, into4i(ated with religion, re0used to listen to
reason. They destroyed and (on0is(ated (hur(hes without any pro)o(ation. *hur(h
leaders su(h as bishops and priests ha)e been harassed, detained and humiliated sin(e
the -slamists sei+ed power in a military (oup in &A#A. -0 anything /udan has witnessed

9ow the -slamists, who had waged =ihad, or the holy -slami( war, in the south, are
turning around and telling us that they are promoting (o.e4isten(e between (hur(hes

re(ruit a 0ew people 0rom the northern states. We appointed a 0ew lawyers 0rom

A" -n my )iew, as in our re(ommendation 0ollowing the tour, the go)ernment should
gi)e parti(ular attention to the prisons. -t should interest some 0unding agen(ies or
some go)ernments to 0und the re(onstru(tions o0 prisons in /outhern /udan . The
(ondition under whi(h the prisoners are in, and, there0ore, the (ondition in whi(h the
prisoners li)e is beneath human dignity.
-t1s a matter - 0eel strongly must be addressed by the go)ernment.
5uring our tour, we 0ound that the 0ew prisons that were (onstru(ted during the
(olonial period in 7uba , Wau, Gambio and Rumbe' ha)e large wards with reasonable
)entilations. 2ut they now need reno)ation so that the lea'ages stop, the gapping
walls are (losed, the sanitation is put right. ;)ery ward should be made usable to
allow 0or proper and separate a((ommodation o0 di00erent (ategories o0 prisons.
Women, male adults, =u)enile and lunati(s Q these are people you (annot put together.
Fnly, we did not see the Mala'al prison. They say they were not ready when we were
in Mala'al.
H" What else should be done to impro)e prison (onditions in /outhern /udan N
A" 9ew prisons should be (onstru(ted in other state (apitals and in the (ounties. We
ha)e to organise our prison ser)i(e, as well as our poli(e ser)i(e and our (ourts. These
are prere?uisites 0or a good =udi(iary. They show that the suprema(y o0 the rule o0 law
is operati)e, and the en0or(ement o0 the rule o0 law is e00e(ti)e. People will 'now that
there1s a prison you1ll be sent to unli'e during the 2 plus years Cin the bushE where
you had (ommitted the worse (rime on earth i0 you (ould pay the (ompensation, or
garama, you went your way and pro(eeded to (ommit another (rime the ne4t day.

in /outhern /udan .

law. Many 0oreigners e)erywhere in the world, we hear o0 them, are in prisons.
;4(ept that in our situation we are a small people. /o, the big people want to use their
mus(les. They should in)estigate. They should (ome and 0ind out what1s happening
with their (iti+ens. -0 their men are in prison, they should 0ind out whether they are

awaiting trial or are being properly a((ommodated in prison. They should also 0ind
out whether or not they are being treated separately di00erent 0rom other prison
inmates. These are the things they should loo' into be0ore they (omplain.
Ges, we ha)e our (onstraints. <oreigners don1t e4pe(t us to put any person who has
)iolated the law in a hotel.
People should realise that we are starting 0rom s(rat(h. Those (ountries C ,enya and
Australia E are produ(ts o0 a system that has been running 0rom time immemorial. We
are not the same. We are at the )ery 0oot o0 the ladder o0 state organi+ation, o0
(i)ili+ation in southern /udan . There1s no other (ountry li'e us. Maybe ;ast Timor
C0ormer Portuguese (olony anne4ed by -ndonesia whi(h got its independen(e in
22E. 2ut ;ast Timor was under (i)ili+ed people and it1s now older in this than we
are. /o is ;ritrea .
5uring our tour, we 0ound some 0oreigners in 7uba prison. We also 0ound a 0ew in
Gambio prison.

A" They are 0rom neighbouring (ountries. We also 0ound some in 2or.

H" There is a big southern population in ,enya . /ome ha)e had problems with the
law there.
A" Parti(ularly, ,enya shouldn1t tal'. Fur people ha)e died in ,enyan prisons 0or
su(h simple things as being 0ound with a bullet. When we were (oming out o0 war,
bullet was the normal thing in our li)es. -0 you made a mista'e and a bullet got into
your po('et or your suit(ase and you went to ,enya you were in trouble. - 'now a
(hap who was 'illed in prison in ,enya . /o people who li)e in glass houses shouldn1t
throw stones.

A" We started negotiating with :ganda in 2&. 2y 23 :ganda ga)e its (onsent to
train our lawyers, and the 0irst badge o0 2 lawyers was admitted 0or post.graduate
diploma (ourse. <i0teen o0 them now hold their diplomas.
As well as in Mar(h 2! we sent $ lawyers to 9airobi to learn ;nglish. A0ter
passing their ;nglish, they will ?uali0y 0or diploma (ourse in :ganda . The Baw
5e)elopment *entre CB5*E in :ganda has o)eremphasi+ed the need to pro)ide
appli(ants 0rom /outhern /udan with su00i(ient ;nglish be0ore sending them to
:ganda .
We are seriously (onsidering training lawyers in ;nglish internally. The $ lawyers
we ha)e sent to ,enya are (osting us $, dollars 0or si4 months. -t1s e4pensi)e.

re(ruiting 5in'a in the =udi(iary. Another (riti( alleged in a statement re(ently that

A" Bet me start with the 0irst ?uestion. 9o, we are not setting up a 5in'a =udi(iary in
/outhern /udan . We are setting a national =udi(iary o0 all /outhern /udanese who are
(ompetent and ?uali0ied.
Ges, the /upreme *ourt was predominantly 5in'a. Fut o0 se)en o0 us, 0i)e are 5in'a.
Two are 0rom other tribes. -t was not deliberate. We had no eligible (andidates. - went
out o0 my way be0ore the *PA was signed to try to (on)in(e 5r. Ri(hard Mulla to
be(ome my deputy in the ne4t 0ormation a0ter the *PA. 5r. Ri(hard was agreeable in
2$ by 23 he had (hanged his mind. And when - (alled him in /eptember or
F(tober 23 to (on0irm with him our pre)ious understanding, 5r. Ri(hard told me
that his people wanted him in the assembly to represent them in the go)ernment o0
/outhern /udan .
Right now, - ha)e re(ommended a guy who graduated in &A!# or &A!A, a non.5in'a. -
le0t the re(ommendation with the president C/al)a ,iirE the day be0ore - le0t 0or /outh
A0ri(a . -0 the president appro)es this, it1s not going to be e4a(tly a balan(e but we
will ha)e at least 0our and three in the /upreme *ourt.

High *ourt, we ha)e many o0 them. 2ut there are also other tribes. We are o)er
(ons(ious about balan(e.
9ow let me address your se(ond ?uestion about the alleged in(ompeten(e in the
=udi(iary. -n 0a(t, the press statement you were re0erring to was released by a (hap
(alled 5ong /amuel. - a((used him o0 playing into the hands o0 ad)ersary. When you
say that the =udi(iary is on the )erge o0 (ollapse you are (on0irming the thesis o0 the
Arabs that the southerners are not able to manage their own a00airs.
This is the third atta(' by this (hap. The two happened when we were in the struggle.
-n one meeting he des(ribed the =udi(iary as one with a rotten head. Then a (olleague
(limbed down )ery hard on him, des(ribing his remar' as 8bad, bad tal'1. Then
another time in Rumbe' there was an -ngessina 0ellow 0rom /outhern 2lue 9ile who
had mas?ueraded as a lawyer and we appointed him as a =udge. At that time we had
no way o0 )eri0ying ?uali0i(ation. We (ouldn1t as' people to produ(e their law
degree. We now insist we see somebody1s degree. We appointed him and sent him to
2lue 9ile . - thin' the Go)ernor 'new his ba('ground. And the Go)ernor was
horri0ied by the e4(esses in the way he was running the =udi(iary. And the Go)ernor
too' measures against him. 9ow - was atta('ed that - did not prote(t the 0ellow.
-n any (ase - wouldn1t ha)e 'ept ?uiet i0 - 'new that there was something wrong. He
did not (ome to as' me what had happened. He =ust atta('ed me in a maga+ine
published in ,enya . - ignored it. -1m not bitter. -n a demo(ra(y, you (an ha)e your

A" We are not )ery good at 0ore(ast. The data whi(h we base 0ore(asts on is not there.
The time management is not there. 9obody has a sense o0 time.
Ha)ing said that, -1m optimisti( that i0 our assembly gets e00e(ti)ely to pass the laws
this year, and our budget is sorted out, and we train our =udi(iary and support sta00,
built (ourts, there1s no reason why our =udi(iary should not pi(' up.
We are wor'ing )ery well in the /upreme *ourt. There are no misunderstandings, no
=elousy, and no hostility. We =ust hope that as we go 0orward we ensure balan(e in our
establishment.
We also e4pe(t members o0 GF// parti(ularly the Go)ernors get to understand their
role and get to be supporti)e to the =udi(iary rather than be obstru(ti)e and inter0ere in
the wor' o0 the =udi(iary.
-1m glad that the president C,iirE has been playing a good role sin(e last year,
emphasising that =udi(iary is independent, =udi(iary must be supported, and =udi(iary
must be allowed to do its wor'.

-t will be a hot summer in ,hartoum this year. The -slamists ha)e raised the politi(al
temperature in 5ar0ur so high so that they 0orgot that they would 0a(e
the (onse?uen(es. They thought they would apply the same s(or(hed.earth poli(y in
5ar0ur as they had done in the south 0or more than 3 years without the world
rea(ting.
-t was a mista'e.
-n the ran's o0 5ar0ur rebels are (hara(ters who used to (ommit atro(ities . in the
name o0 Arab -slami( solidarity Q in the south. Those people are now engaged in
serious soul sear(hing e4er(ise. As re(ently as 23, the people o0 5ar0ur had
(onsidered themsel)es, at least psy(hologi(ally, as light s'inned or brown as Arabs,
but they are now ha)ing a se(ond thought o)er their identity.
Those who 'now them well are stunned to hear them now ma'ing the loudest noise
about human rights abuses in 5ar0ur . These were the same people who used to deny
that atro(ities were being (ommitted in the south when they were bed0ellows with the
-slami( wing o0 President Fmar al 2ashir.
Many o0 the 5ar0ur rebel leaders were, in 0a(t, part and par(el o0 the (urrent
,hartoum regime set up, 0ollowing an -slami( (oup in &A#A, to turn /udan upside
down.
That re)olution has now split, some say ta(ti(ally be(ause the -slamists, anti(ipating a
global ba('lash, wanted to ensure the sur)i)al o0 an -slami( mo)ement, at any (ost, in
/udan . -n other words, the -slamists ha)e re0used to put their eggs in one bas'et.
At the end o0 the day, it all amounts to the game o0 politi(al sur)i)al. -t1s this game
whi(h is raising the politi(al temperature in ,hartoum today. And it1s prompting the
-slamists to (ling on to power by all means. <or them, the whole world, with
e4(eption o0 *hina and Russia , is out there it(hing to get them.
- don1t blame them. A0ter all, the rami0i(ations o0 the warrants issued by the
-nternational *riminal *ourt C-**E, based in The 9etherlands, 0or the arrest o0 a
