RE: Repeat request for legal opinion regarding the nature of recent
meetings between Israeli whistle-blower Rafi Rotem and staff of the State
Ombudsman's office
Attorney Bar-El:
My August 15, 2014 request asked for your legal opinion regarding a series of
meetings of Tax Authority whistle-blower Rafi Rotem with staff of the State
Ombudsman's office:[1]
Were you witness to any procedure, conducted during the above
referenced meetings, which constituted "providing testimony", pursuant
to the law of the State of Israel?
Your response today, [2] on my above referenced request in part says:
Even if you intended to pay for the requested opinion (our fees for such
opinion is $15,000+VAT), I would refuse to accept such assignment.
Let me my it clear:
On various occasions, in the presence of Rotem's supporters, both before and
after the above referenced meetings, you referred to such meetings as
"providing testimony".
Upon review of the facts in this matter, my opinion is that such statements by
you were false and misleading.
Therefore, my request for your opinion, was intended to provide you an
opportunity to correct such false statements, made by an attorney, who is:
The CEO of a non-profit association "Ogen- for fighting corruption";
The one who brokered the meetings, and
The one who participated in such meetings as Rotem's counsel,
following an unusual instruction by the State Ombudsman's office in his
April 29, 2014 letter. [3]
Due to the high public policy significance of the Rafi Rotem affair and based
on my experience in Human Rights international review processes, I opine that
if you persist in your refusal to respond on my request, your conduct would be
deemed part of fraud, violations of Human Rights, and evidence of high-level
corruption of the justice system and the legal profession in the State of Israel.

Therefore, I still hope that you would respond on my request for your legal
opinion in this matter within the time specified in my August 15, 2014 request.
