FACTS

Petitioner is the registered owner of parcels of land in Teresa, Rizal. Mainly lots no 59534, 59445, 59446 and 59444. On November 29, 1973,
petitioner executed two deeds of sale in for the respondent. The first Deed of sale was for lots 59534, 59445, and 59446. The second deed of
sale was for lot 59444. With this, respondent was able to pay Php 275, 055.55 as partial payment for the two parties for the initial payment and
the first instalment.
On march 17, 1978, petitioner sent to the respondent a letter of the cancelation of the conditional deeds of sale. Respondent filed for specific
damages and performances of the petitioner. Petitioner argues that the case be dismissed, thus it could be compelled to execute any deed of
absolute sale because respondent failed to pay in full.
Respondent denied receiving the notices of notarial rescission sent by the petitioner, it was found out by the court the petitioner sent the
notices of notarial rescission to the wrong address.

ISSUE
A. Whether or not respondent is entitled to the relief granted by CA.

HELD
No. Respondent is not entitled to the relief of the Court of Appeals. CA found out that respondent was served with the notice of notarial
rescission of the conditional deeds of sale on February 16, 1995 in relation to the its first complaint filed on November 28, 1994 with the
RTC of Antipolo City.
