List the four most common ways that defendants secure pretrial release.
A. Cash bondrequirement that money be posted to secure pretrial release
a. All money will be returned once all court appearances are satisfied.
b. To keep a person in jail for a while, a cash bond may be set high.
i. Ex of cash bond: $3,000 cash bond on a FTA (failure to appear) for child support
hearing.
B. Property bondUse of property as collateral for pretrial release.
a. Ex: A bondsman would allow a house to be put up for $100,000 bond for a robbery the
defendant committed
C. Release on recognizance (ROR)The release of an accused person from jail on his or her own
obligation rather than on a monetary bond
a. Ex: DUI would be sent to a drunk tank, then released on ROR, then would be given a trial
date.
D. Bail agent/bail bondsmanA person whose business it is to effect release on bail for persons
held in custody by pledging to pay a sum of money if a defendant fails to appear in court as
required.
