Meetings with representatives from Waste Management and Wheelabrator

Dear Ms. Coffey,

The purpose of this letter is to request that the County agree to participate in the
mediation program within the Office of the Attorney General as per F.S. 16.60 regarding the
closed session negotiation meetings being held between representatives of the County with
representatives of Waste Management and Wheelabrator, (hereinafter referred to as "WM" and
"WTI" respectively).
It is our position that these negotiations are not being conducted
consistent with the Florida in the Sunshine requirements. It is long standing law that the Public
Meetings requirement is to be broadly applied. Wood v. Marston, 442 So.2d 934, 938 (Fla.
1983). Nor, do these negotiations fall within the ambit of F.S. 286.0113, which provides very
limited exemptions to the public meeting requirements. We have made several requests for the
authority on which you are relying in opining that these negotiation sessions can be held in
nonpublic meetings. Despite our numerous requests, no such authority has been provided us by
your office.

By participating in this mediation program, it is our hope that this issue can be resolved
amicably. Please advise me no later than 5:00 pm on Friday, January 16 whether the County will
agree to participate in the Attorney General's mediation program.
