Preface
In this publication, we have presented statistical data on reported, accused and convicted adult and juvenile perpetrators of
crimes for 2011, as well as comparable data for the period 2002-2011.
These data are a result of the regular annual statistical surveys and provide information about the perpetrators of crimes in all
phases of the procedure, starting from the submission of the report until the final sentence.
In defining the content of the presented data, we have taken into consideration the needs of the users, especially the State
Bodies and the Scientific-Research institutions that are active in the field of studying crime and its forms.
We hope that this publication will be well received by all users.
All comments and suggestions aimed at improving the content of this publication would be greatly appreciated.

Notes on methodology
Sources and methods of data gathering
Judicial statistics are based on data gathered by regular statistical surveys on perpetrators of criminal acts. Data presented
in this publication are gathered by individual statistical questionnaires filled in by public prosecution offices and courts of the first
instance, while data processing is done at the State Statistical Office of the Republic of Macedonia.
Scope
Data on indicted adult perpetrators refer to all persons against whom, after an indictment, charges were brought and the
criminal proceedings were effectively completed in the course of the respective year.
Data on indicted juvenile perpetrators refer only to juveniles against whom criminal proceedings initiated in the juvenile
court are effectively completed in the course of the respective year. The data on criminal convicts cover adults and juveniles who are
convicted by an effective decision of the courts of general jurisdiction.
Therefore, the total number of adult convicts includes those who are sentenced to the penalties prescribed in Article 33 of the
Criminal Code of the Republic of Macedonia (Official Gazette of the Republic of Macedonia. No 19/04), convicts where no punishment
was imposed according to Article 42 of the Criminal Code of the Republic of Macedonia, and those penalised by a court reprimand
or one of the correctional measures stated in Article 74 of the Criminal Code of the Republic of Macedonia (Official Gazette of the
Republic of Macedonia No 19/04), such as measures of intensified supervision or assignment to some correctional institution.
The crimes are classified into groups of crimes, based on the Classification of Crimes, which is derived and based on the
Criminal Code of the Republic of Macedonia by articles and paragraphs of a particular crime.
Definitions of some terms and topics
Adult perpetrators of crime
"Adult perpetrator of crime" is a person who has committed a crime and who at the time of committing the crime had reached
18 years of age, and has committed the crime as: executor, accomplice, initiator or assistant.
"Person reported as known perpetrator" is an adult perpetrator of a criminal offence against whom proceedings based on
criminal charge and committal proceedings have been concluded with the issuance of an order by which: the charge is rejected, the
investigation is stopped, the investigation is suspended or a charge has been applied.
"Person reported as unknown perpetrator" is an unknown person who was charged for a criminal offence in the Public
Prosecutor's Office, and who remains unknown even after one year from the day of filing the charge.
When more persons have participated in committing a crime, every participant is considered as a unit of observation, and the
crime is registered for each participant, where complicity is established with an answer to a particular question.
"Accused person" is an adult person against whom a proposed indictment or private suit is filed. It also refers to a person
against whom legal proceedings have been concluded with a valid court decision.
"Convicted person" is an adult person recognized as responsible, against whom penal measures have been imposed.
"Type of decision" is a decision by the Public Prosecutors Office by which the legal proceeding is finished, or a court decision
by which the proceeding is legally closed.
Criminal sanctions are: punishments, alternative measures, security measures and educational measures.
For the crimes they have committed, the criminally accountable persons can be sentenced as follows: imprisonment, fine,
a ban from performing their profession, activity or duty, a ban from driving a motor vehicle and expulsion of a foreigner from the
country
The data on damaged property resulting from the crime are shown for all crimes for which the reporting units responded that
there is damage to property.
The data about the crime: name of crime, article, paragraph, item, connection with other crimes and the applied criminal
law are collected based on the decisions of the Public Prosecutors Office, i.e. Court, according to the pronouncement of the final
decision.

Juvenile perpetrators of crime


"Juvenile perpetrator of crime" is a perpetrator of a crime who at the time of the execution of the crime had reached the age
of 14, but not yet the age of 18, and has preformed the crime as: executor, accomplice, initiator or assistant.
"Reported juvenile" is a juvenile against whom the legal procedure after the filed charges was not raised (the charge was
rejected), against whom the proceeding has been stopped or a proposal has been applied for pronouncing a penalty or educational
measure.
"Accused juvenile person" is a juvenile against whom the proceeding in front of the Council has been stopped or no legal
sanctions have been pronounced, as well as a criminally insane juvenile against whom a decision for security measures has been
pronounced.
"Convicted person" is a juvenile perpetrator of crime against whom with a Court decision a legal sanction has been pronounced
- juvenile imprisonment or educational measures.
A juvenile who committed crime with completed 14 but not yet 16 years of age can not be punished, but educational measures
can be pronounced and is considered as a "younger juvenile". A juvenile who committed a crime with completed 16 but not yet 18
years of age and who can get a penalty of juvenile imprisonment is considered an "older juvenile".
"Legal sanctions" are the pronounced penalties - juvenile imprisonment and educational measures such as: disciplinary
measures, intensified supervision and institutional measures.
"Prior convictions" are all prior convictions - educational measures or juvenile imprisonment.
"Parents of the juvenile" are the parents of the juvenile born inside or outside marriage, and parents who exercise their
parental rights based upon a legal enactment or adoption.
