REMEDIES

- Annulment of Judgement under rule 47

SEC. 32

- Criminal Prosecution under the RPC

1. Remedies available to the aggrieved party. ( to question


the validity of the case)
- Remedy of New trial or reconsideration, under
Rule 37 of the Rules of Court
-Relief from judgement under Rule 38

2. New trial or reconsideration.


- Withing the period for taking an appeal, the aggrieved
party may move the trial court to set aside the judgement
or final order and grant a new trial for one or more of the
causes materially affecting the substantial rights of the
said party.

- Appeal to the Court of Appeals or Supreme Court


in the same manner as in ordinary actions pursuant
to Section 33 of PD No. 1529

- If the motion for new trial is granted, the judgement is


set aside

- Review of Decree under Sec.32 of PD No. 1529

- If the motion for reconsideration is granted, the


judgement is merely amended,

- Reconveyance under Sec. 53 and 96


- Damages under Sec. 32
- Claim against the Assurance Fund under Sec. 95
- Reversion under Sec. 101 of CA No. 141
- Cancellation of Title

- The period for filing either motion is within the period for
taking, not perfecting , and appeal.
- An appeal may be taken withing 15 days after notice to
the appeallant of the judgement or final order appealed
from. Where a record on appeal is required, the appellant
shall file a notice of appeal and a record on appeal within
30 days after notice of the judgement or final order.
