MR js a former member of the Kappa Delta Row (KDR) fratemity, located at 420 E Prospect Ave. HEB stated that the fratemity is operating a private, invite only Facebook page which members share photos of unsuspecting victims, drug sales, and hazing. MINIM stated the drugs included marijuana and edibles, concentrates, ADD medication, and some cocaine, Said page currently has 144 active members which include current students as well as graduates. III keeps his Facebook page deactivated so that the members do not remove him from the group. MERE stated that this page, named "2.0", started approximately 8 months ago when their original page, "Covert Business Transactions", was discovered by a victim and shut down, EINE was visiting the fraternity when a member accidentally left his Facebook page logged in. Kl observed a photograph of her topless which was posted to the group. II became upset and threatened the fraternity, which subsequently shut down "Covert Business Transactions". The new page, "2.0", was created shortly after. MEE provided multiple print outs which will be entered into evidence. A working copy of said photos ‘was made to include with the case jacket. Statements by III of the following photographs were made: 1 - This is the type of stuff that happens at KDR. 2-No comment. 3 - No comment. 4-- MEE commenting he "banged IN 5 - MME commenting on "PSU nude cheerleader" photographs. 6-No comment, 7-No comment. 8- Could find out ID but did not have it tonight, 9 Could find out ID but did not have it tonight. 10- Could find out ID but did not have it tonight. LL Photograph of SJE (can get last name) taken and posted by HE current student, while she was passed out in a member's room, Imi walked in and saw this, at no time was he with this victim throughout the night 12 - Additional copy provided of photograph #11 13 - Photograph of SNMltaken and posted by NEN while she was vomiting in a member's room. I walked in a second time and witnessed this. 14 - Additional copy provided of photograph #13. 15 -No comment, 16 - No comment. 17 - Posted by a member of himself as a joke. 18 - No comment. 19 - Strippers hired by the fraternity for a party. 20 - Strippers hired by the fraternity for a party.hat> als Some of the postings were of nude females that appeared to be passed out and nude or in other sexual or embarrassing positions. It appears from the photos provided that the individuals in the photos are not aware that the photos had been taken. ‘The provided photographs only showcase a small fraction of the posts on the page. IEEE had his laptop and logged in to show that it was still active. INN was instructed fo save as much of the posts as he could in the event he is removed from the page. IEEE is interested in cooperating with law enforcement to stop the posting on the Facebook page and to ‘identify possible victims in the posted materials. INN indicated that almost all the names are nicknames ‘on the postings but he can get most of the real names of suspects and victims. IINNNEI had offered to allow the State College Police to utilize his Facebook account and membership to the page as it would be impossible for anyone who is not a brother to join. INI stated that he accesses the private page from his ‘own Facebook page. INN stated that the fratornity created the private page and then sent out invitations to join, The only way to access the page is through invitation from the person or group that created the page. Affiant is requesting a search warrant for the private Faccbook page titled “2.0” for the contents and to obtain copies of any postings, messages, pictures, names and other information related to possible criminal activity posted on the private Facebook page. Affiant intends to have cooperating informant/eomplainant i_—_a HR access his Facebook account and then the private “2.0” account and allow the police to view and obtain any and all messages, postings and images that may be related to possible criminal activity. Affiant is requesting the search warrant to try and identify the individuals in the photos who may be vietims and to identify who may have been involved with posting and creating the private Facebook page.
