IM is ACK, untess tne context omervise requites, — (a)“advertsement" inchides any visible representation by vay of notice, cireu- lar, label, wrapper or other document end also includes any announcement made orally or by any means of producing or transmitting light, sound, smoke or 835; (b) “cigarette” includes, — (i any roll of tobacco wrapped in paper or in any other substance not containing tobacco, Gi) acy roll of tabaceo wrapped in any substance containing tobaceo, Which, by reason of its appearance, the type of tobacco used in the filter, or its packaging and labellingis likely to be offered co, or purchased by. consumers as Cigarette, but does not include beedi, cheroot and cigar; (c) distribution” includes distribution by way of samples, whether free or oth (4) “export, with its eranmatical variations and cognate expressions, means taking out of India to a place ourside India; (e) “foreign language” means a language which i, neither an Indian language ror the English language; (import, with ite grammatical va bringing into India from a place outside India, (q) “indian language” means. language specifiedin the Eight’ Schedule to the Constitution, and includes any dialect of such language: (A) “abel” means any writen, marked, stamped, printed or grephic matter, affixed to, or appearing upon, any package; package” includes a wrapper, box, carton, tin or other container; ("prescribed means prescribed by rulesmade under this Act: (K) “production”, with ite grammatical variations and cognate expressions, in cludes the making of cigarettes, cigars, cheroots, heeds, cigarette tobacco, pipe to- bacco, Bockak tobacco, chewing tobacco, pan masala or any chewing material hav- ing tobacco as one of its ingredients (by whatever name called) or snuff and shall include— {O)packing, labelling orre-labelling, of containers; ()re-packing from bulk packages to retail packages: and (iii) the adoption of any other method 10 render the tobacco product marketable; jons and cognate expressions, means see. ] ‘THEGAZETTE OF INDIA EXTRAORDINARY, 3 (o)"publie place” means any place to which the public have access, whether as of right oF not, and includes auditorium, heepital buildings, railway waiting room, amusement centres, restsurants, public offices, court buildings, educational insti tions, libraries, public conveyances and the like which are visited by general public but doe: not include any open space; (m)*sale”, with it grammatical variations and cognate expressions, means any ‘wansfer of property in goods by one person to another, whether for cash or on credit orby way of exchange, and whether wholesale orreail, nd inclides an agreement for sale, and offer for sale ard exposure forsale; (2 “smoking”, means smoking of tobacco in any form whether in the form of cigarere, cigar, beedis or otherwise with the aid of @ pipe, wrapper or any other insiru- ments; (0) “specified warming” means such warnings agains: the use of cigarettes or other tobacco products to te printed, painted or inscribed on packages of cigarettes or ‘other tohaceo product in such form and manner as may be prescribed by rules made under this Aet, (p) “tobeeco products” means the products specified in the Schedule, 4. (2) No person shall carry on trade or commerce in cigarettes oF any other tobacco products unless every package of tigarettes or any other tobaceo praducts sold, supplisd or istributed by him bears thereon, oon is bel, the specified warning (3) No person shall impor cigarettes or any other tobacco products for distribution or supply fora valuable consideration or forsalein India unless every package of cigarettes or any other tahacco products so imported by him bears thezeun, oF on is label, the specified waming. (c)any foreign language, the specified warning shall be expressedin the English language; U) partly any foreign language and partly English or any Indian language oF languages, the sperified waming shall be expressedin the English language as well as in such Indian language or languages, (2) No package of cigarettes or any other tobacco products or its label shall contain ‘any matter or tmtement which is incorsistent with, or detracts from, the specified waming, 10. Na specified warning or indication of micctine and tar contents in cigarettes and any other tobacco products shall be deemed to be in accordance with the provisions of this ‘Act if the height of each leer or figure, ar both usedon such waming and indication is less than the height as may be prescribed by rules made under this Act. 1. For purposes of testing the nicotine and tar contents in cigareties and any other vobaeco products the Central Goverariient shall by notification in the Official Gazette grant recognition to such testing laboratory as that Government may deem necessary. 12,(1) Any police fcr, notbelow the rank of asubvinspector orany officer of State Food or Drug Administration or any other eficer, holding the equivalent rank being not below the rink of Sub-Inspector of Police, authorised by the Central Government or by the State Goverment may, if he has any reason to suspect that any provision of this Act has been, of being, concravened, enter and search inthe maaner prescribed, atanyreasemeble time, any factory. building, business premises or any other place — (a) where any trade or commerce tn cigarettes or any other tobacco products is carried on of cigarettes or any other tobacco products are produced, supplied or distributed; or (@) where any advertisement ofthe cigarettes or any other tobacco products has, been oris being made. (2) The provisions of the Code of Criminal Procedure, 1973, shall apply to every search, and seizure made under this Act. 12. (1) Ifany police officer, notbelow the rank ofa sub-inspector or any officer of State Food or Drug Administration or any ether officer, holding the equivalent rank being not below the rank of Sub-Inspector of Police, authorised by the Central Government or by the ‘State Government, has any reason to believe thas. — (o) in respect of any package of cigarettes or any other tobacco products, or (8) in respect of any advertisement of cigarettes or any other tobacco products, the provisions of this Act have been, or are being, contravened, he mey seize such package ‘or advertisement material in themanner prescribed (2) No package afeigarettes or any other tobacco products or advertisement material seized under clause (a) of sub-section (1) shall be retained by the officer who seized the package or advertisement material fora period exceeding ninety days from the date of the seizure unless the approval of the District Judge, wrthin the local limits of whose jurisdiction such seizure was made, has been abtained for such retention. 14. Any package of cigarettes or any other tobacco products or any advertisement materiel of cigarettes or any other tobacco products, in espect of which any provision of this Act has been or is being contravened, shal be liable to be confiscated: Provided that, where it is established to the satisfaction of the court adjudging the confiscation that the person in whose possession, power or control any such package of ‘cigarettes or any other tobacco products is found is nat responsible forthe contravention cf the provisions ofthis Act, the Court nay, insiced of making an order for the confiscation of such package, make such other order authorised by this Act against the person guilty ofthe breach of the provisions of this Actas it may think fit. (2) Whenever any confiscation of any package of cigarettes or any other tobacco products is autherised by this Act, the court adjudging it may, subject to such conditions as may be specifiedin the order adjudging the confiscation, give tothe owner thereof an cption to pay. in liew of confiscation, costs which shall be equal othe value ofthe goods conviscated. (2) On payment of the costs ordered by the cour, the seized packages shall be re~ {umed othe person from whom they were seized on condition that such personsall, before making any distribution, sale or supply of such packages of cigarettes or other tobaceo products, get the specified warning and indication of nicotine and tar contents incorporsted tm each such package. 16. No confiscation made, costs ordered to be paid under this Act shall prevent the infliction of any punishment to which thepersan affected thereby s liable under the provisions. ofthis Act or under any other law. 17, Any confiscation of cigaretes o: any other tobacco products may be adjudged or costs may be ordered to be paid (0) withoutany limit, bythe principal eivil courtof original jurisdiction within the local limits of whose jurisdiction such confiscation has been made, costs have beens ‘ordered to be paid, (&) subjectto such limits as may be specified by the Central Goverment in this, behalf, by such other court, not below a civil court having pecuniary jurisdiction exceeding rupees five thousand, asthe Central Goverment may, by notification inthe Official Gazette, authorise in this behalf 18, (1) No order adjudging confiscation or directing payment of costs shall be made unless the owner or person in possession of the package of cigarettes or any other tobacco products has been given a notice in writing informing him of the grounds on which it is proposed to confiscate such package, ond giving hima reasonsble cpportunity of making & fepresentarion in writng, within such reasonable time as may be specified in the notice, against the confiscation mentioned there, and, ifhe so desires, of being heard personally cor through a representative in the mater: Provided that, where no such notice is given within a period of ninety days from the date of the seizure of the package of cigarettes or of any other tobacco products, such package shall be resumed, after the expiry of that period, to the owner or the person from ‘whose possession it was seized, (2) Save as otherwise provided in sub-section (1), the provisions of tne Code of Civit Procedure, 1998, shal, as far as say be, apply to every proceeding refered to in sub- section (1). 19. (1) Any person, aggrieved by any decision of the court adjudging a confiscation, ordering the payment of costs, may prefer an appeal to thecaurt to which an appeal les from the decision of such court (2) The appellate court may, after giving 10 the appellant an opportunity of being heard, pass such order as it thinks Fit confirming, modifying or reversing the decision oF Seder appealed against or may sendback the case with such drections as it may tink fit for a resh decision or adjudication, asthe case may be, iter taking addilional evidence, if necessary: Provided that en order enhancing any fine in Yeu of confiscation or confiscating of goods of greater value shall not be made under this scetion unless the appellant hes had an Spportanity of making a representation and, iF he so desires, of being Heard in person or through a representative in his defence. (J) Any person who produces or manufactures cigarettes or tobacco products, ‘which do not contain, eiter on the-package or on their label, the specified warning and the nicotine and tar contents, shall in the case of first conviction be punishable with imprisonment for aterm which may estend to two years, or with fine which may extend to five thousand rupoes, or with both, and for the second or subsoqueat conviction, with impriscnment for a ‘erm which may extend to five years and with fine which may extend to ten thousand rupees. (2) Any person who sells or distribuies cigarertes cr tobacco products which do not ‘contain either on the package oror their label, the specified warning and the nicatine and tar contents shall in the case of fint conviction be punichable with imprisonment for a term, ‘which may extend to one year, or with fine which may extendto one thousand rupees, or with oth, and, forthe setond or subsequent conviction, with imprisonment for aterm which may ‘extend to two years and with fine which may extend to three thousand rupees. 21. (2) Whoever contravenes the provisions of section 4 shall he punishable with fine ‘which may extend to two hundred rupees. (2) Anoffeace under thie section shall be compoundableand shall be tried summarily in accordance with the procedure provided for summary trials in the Code of Criminal Procedure, 1973. 22, Whoever contravenes the provision of section 5 shall, on conviction, be punishable— (a) nthe case of first conviction, with imprisonment fora term which may extend to twa years or with fine which may extend to one thousand rupees or with beth, and {b)inthe case of second or subsequent conviction with imprisonment for aterm ‘which may extend to five years and with fine which may extend to five thousand rupees. 23. Where amy person has been convicted under this Act for the contravention of the provision of section 5, the advertisement and the advertisement material for cigarettes and ‘other tobacen products may be forfeited to the Goverment and such advertisement and advertisement material shal be disposed of in such manner as may be prescribed by rules mage under ths Act. 24. (J) Any person who contravenes the provisions of section 6 shall be guilty of an offence under this Act and shall be punishable with fine which may extend to 1wo hundred rupees. 2) All offences under this section shall be compoundable and shall be tied summarily in accordance with the procedure provided for summary trials in the Code of Criminal Procedure, 1973, 25. (1) Notwithstanding anything contained in any other law for the time being in force, the Ceniral Government or the State Goverament may, by notification in the Official Gazette, authorise one or more persons who shall be competent to act under this Act Provided thatthe person so authorised may, ifhe has reasonable ground for believing, that any person hes committed an offence under section 4 or section 6, may detain such ‘person unless the accused person furnishes his name and auldress, and otherwise satisfles the officer detaining him that he will duly answer any summons or other proceedings which may be taken against him, (2) Any person detained under sub-section (7) shall forthwith be taken before Magistrate tobe dealt with according to law. (4) Every notification issued under sub-sections (1) and (3) shall be published in the (Official Gazerte, anda copy thereof shall be exhibited far information to the public in some ‘conspicuous place or places as the State Govemnment may direct, (5) Every person authorised under sub-section (J) shall be deemed to be a public servant within the meaning of section 21 of the Indian Penal Code. 26.) Where an offence under this Act has been commited by a company; every person who, atthe time the offence wes commnitted, was in charge of, and was responsible to, the cdmpany for the conduct of the business of the company, as well as the company, shall be deemed to be guilty of the offence and shall be lisbe to be proceeded against and punished accordingly: Provided that nothing contained in this sub-section shall render any such person liable to any punishment, if he provesthat the offence was committed without his knowledge orthat he had exercised all due diligence to prevent the commission of such offence. (2) Notwithstanding snything contained in sub-section (1), where any offence under this Act has been committed by & company and itis proved that the offence has been ‘committed with the consentor connivance of, ori attributable to any neglezt onthe part of, ty diester, manager, secretary or ather ficar af the company, eich dimer, manager Secretary or other officer shall be proceeded against and punished accordingly Explanation. —For the purpases of this section, (@)"company”" means. body corporate andincludes a firm or other association of individuals; and (®)“director’, in relation to a firm, means.a partner inthe firm. 27. Notwithstanding anything contained in the Code of Criminal Provedure, 1973, an offence punishable under this Act shail be bailable. 28, (/) Any offence committed under section 4 or section 6 may either before or afier the institution af the prosecution be compounded by such officer authorised by Central Government or State Government and for an amount which may not exceed two hundred rupees. (2 Where an offence has been compounded under sub-section (1), the offender, fin ‘custody, shall be discharged ané no further proceedingsshall be taken against him in respect of such offence. 29, No suit, prosecution or other legal proceeding shal lie against the Central Governmentor any State Govemment orany officer of the Central Govemment or any State ‘Government for anything which is in good faith done or intended to be done under this Act 30. Where, however, cinema and television programmes which have been produced prior fo ths notification have scenes wih smoking situations and use of other forms of tebacco, it shall be mandatory to place a heaify warning as a prominent scroll of the bottorn of the television or cinema screen with font in black colour on white background which és legible-and readable, The text of the warning shall be ‘Smoking causes cancer’ or ‘Smoking kills’ for smoking form of tobacco use and ‘Tobacco causes cancer' or ‘Tobacce kills’ for chewing and other form of tobacco. Supply and Distiipution (second! Amendment) Rules, 2005. (2) They shall come into force.on the 1 day of January 2006. 2. In the Cigarettes and other Tobacee Products {Prohitstion of Advertisement and Regulation of Trade and Commerce, Production, Supply end Distribution {Amendment Rules, 2004, in rute 4,- {for sub-zule (6) tho following shall be substituted, namely:- “é) No individual or a person or a choracter in cinema and television froaremmes shat! display tobacco proaucis or theit use: provided thet ths sub-tule shall not apply to (2) thdian films and tetevicon Programmes displaying use of tobaceo oducts necessary to represent the smoting or lobacco usage of Peal historical figure or for representation of a historical eros {0} Old incion’ fims and television programmes, produced Prior 18 coming into effect of this notification, being screened in a cinema hall or theaire or aed on television: 45 THEGAZETTE OF INDIA : EXTRAORDINARY. [Parr It—see. 300] {e} Foreign films and television programmes, including dubbed or sub- titted foreign films or television programmes, being screened in cinemas halls of theatres oF aired on television, {d) Indian or foreign films and television programmes, displaying use of tobacco products, in cose of documentaries or health spots made to clearly and unembiguously reflect the dangers and dire consequences of lobacce use; fe} Uve coverage of news, cument offoits, interviews, public meetings, sports events, cultural events and the like. being telecast on television whereby there 5 a purely incidental and completely unintentional coverage of use of tobocce products: Provided that the exemptions under clauses (a). (bJ. (Cl, (d) & (e abeve shall not extend fo display of brands of fobacce products or tobacco product placement in any form. Close ups cf cigorette packages or jobacco produets shall not be permissible and such scenes shall be edited by the producer/distrivytar/broadcaster prior to sersering in cinemas/theattes or airing on jelevision. Expionation (1).- For the purpose of this sub-+ule, all films that receive CBFC cerlificaiion prior fo the effective date of this nofification shall be categorized as ‘old films’ Explanation (2),-For the purpose of this sub-ule, “Foreign film’ implies ‘Imported’ as defined in tho Cinomatogtaph (Centiication} Rules, 1983, {6A] It shall be mandatory for the producer or diskibulor of the film to include anti tobacco health spots of minimum thinly seconds curation in the moster print, 10 be scigened at the beginning, middle and end of the sci film. In case of ald Indion films, the owner or manager of the cinema hat or theclie where the fim is being screened shall ensure thet these anti jobaces healin spots are duly screened as prescribed, The provisions of this sub-rule shall not apply to clause {dj of sub-rule 6. 163) In case of television programmes, it sha be mandatory for the broadcaster to ensure either placement ot an ont tobacco health waming as a prominent scroll at the bottom of the television screen during the petiod of such aisploy or ifing of anti tobacco health spots for a petiod of minimum thirty seconds during tho telecast of each television programme of thirty minute duration or less. In case the television programme is more than thirty minutes further cirime of 30 seconds shall be dliocated for each incremental thity minutes, for telecesting anti tobacco spots. The minimum duration of each anti tobacco spot shall be not less than 18 seconds. The provisions of this sub-rule shall not apply to clauses (d) and (e} of subrule 6: (mn-ws39) SRO ST TITY : SATU fii) (ii) Provided that, the anti tobacco health waming scroll shall be legible and readable with font in black colour on white background. The text of the health waming shail be ‘Smoking causes cancer' or “Smoking kils' for smoking form of tobacco use and ‘Tobacco causes cancer’ or ‘Tobacco kills’ for chewing and other form of tobacco orsuch other ‘worning as may be specified by the Goverment: Provided further thot, the anti tobacco health waming scrolls or health spots shail be in the same language(s) as used in the film or television Programme. incase of dubbed or sub-iited films or television Programmes, the scrolls or spots shall be cared in the language of Subbing or sub-tilement” for sub-rule (7).the following shall be substituted, namely:- “Wherever brand names or logos of tobacce products form a part of the Fictures to be printed in any form of print or outdoor madia or footage to be aired through any form of electronic media, it shall be mandatory for the media to crop or mask the same to ensure that the brand namer and logos of the tobacco products are not visible, except in case of live or delerred live telecast of sports, cultural and other events/activilies held in other counties being aired on television in India”. after sub-rule [7).the following sub-rule shall be inserted, namely:- “i8) A Steering Committee shail be constituted under the chairmarship of the Union Health Secretary with representation from among others the Minisiry of Information & Broadcasting, Ministry of Law & Justice, Advertising Standards Council of india, Press Council of India, Members of Parliament and voiuntary organizations.
