We have taken note ofthe following: 41, That several provisional charges have been laid against Mr. Dawood Rawat before the District Court of Port Louis. 2. The motion of the prosecution before the District Court of Port Louis for the Issue of a Warrant of arrest, which was initially turned down by the Court and subsequently granted following anew application. 3, The testimony of Chief Inspector Jeavoo of the CCID in court that the Police ‘wanted to know the whereabouts of Mr. Dawood Rawat since they had {information to the effect that our client was one of the beneficiaries of this, alleged “financial scandal’ 4. The statements of Ms. Kesri Soochit State Counsel in Court that there was no {international arrest warrant against our client but an arrest warrant to locate our client. ‘We would like to point out that at no time whatsoever has any person from the Police or your Office asked us for the whereabouts of our client and whether we would ask our client to come to Mauritius for questioning. We have also taken note of the fact thatthe Prime Minister and other Ministers of the Government of Mauritius have held several press conferences, wherein they have all unlawfully made serious, reckless, baseless, unwarranted and unfounded accusations against our dient and other members of his family. Based on the above itis fair to say that our client fears that there can be no fairness in the enquiry since members from the highest echelon of government headed by no other than the Prime Minister and Minister of Interior, have already ascribed themselves the role of investigators, judge and jury against our client Our client requests that there should be fairness and due process. He cannot travel ‘to Mauritius since his state of health does not permit. He has always wanted to collaborate with institutions that are legally empowered to carry out investigations. In the circumstances, our client requests that the relevant authorities in Mauritius "urgently proceed by way of letters rogatory. He is ready and more than willing to Present himself before a Judge in France to answer all questions the relevant authorities in Mauritius wish to put to him through the process of “commission rogatoire". We hope that you will proceed accordingly as soon as possible. Please let me have your stand.
