For 415V DG Sets: The equipment shall be delivered at our site and to be commissioned within 21 days from the date of release of Advance Payment. 2) Rent: While we appreciate your gesture in arranging for the start up power in consideration of the aspects mentioned in your letter dated 28% Feb, 2011, we would be paying a token rent of Rs.7, 500/- per MW (Rs.Seven Thousand Five Hundred only) per month, payable on 5‘ of every month, in recognition of the ownership of the equipment by you, Any Taxes payable on the rent shall be in MPL account. 3) Duration of the rental: This work order is for a period of 3 months from the date of commissioning of the sets and subject to mutual acceptance for extension thereafter. 4) Advance: MPL will pay an amount of Rs.2.5 Crores (Two and Half Crores Rupees Only) as interest free advance and same shall be deducted from sujana Towers Limited R/A bills of service Order @ of 20% each bill of transmission line Erection (Service Portion) Component and balance in any, from 10% retention amount. 5) The following facilities would be provided by us free of cost: a. Covering for required area with M30 concrete flooring and foundation of the gensets, with suitable slope for drainage of water. Accommodation for the operating staff. Potable water, about 12 KL/Day. Diesel and Lubricating Oils on actual consumption basis. 440 V power for 50 HP, Load to run the compressors, cooling towers and fuel pumps. Kiosks for installation of Power & Control panels. b. Necessary DB / MCC for further distribution of 415V Power supply to compressors, cooling towers and fuel pumps. c. Required size and length of HT power cables for taking power from DG Sets / Breaker panel to our 6.6 kV switchgear, not exceeding 200 M in length. . Suitable rating compressors. Cooling Towers Base frames for pump motors. Generator control & relay panels. . Breaker control panels & Synchronising panels. NGR panels. Diesel storage tank and diesel transfer pump including day tank with necessary piping kk. Any auxiliaries to keep the DG sets in continues operation. 1. Any other spares etc. Crop oes 6) All permissions and Licences to operate these gensets at our premises, including but not limited to Electrical Licenses, Pollution Clearance etc., would be arranged by us. 7) Possession: At all times it is deemed that the equipment is in your possession and control and therefore it is your responsibility to operate them, maintain them and to generally take care of these equipment. It is expressly understood that at the end of the rent period, you are at liberty to dismantle and take away your gensets at your cost without any hindrance or let from us or from anybody claiming on our behalf. 8) Lien: No lien of any kind shall be exercised by us on these gensets and neither will we recognise any claim or demand by any third party or any person claiming on our behalf. 9) Insurance: To be arranged by you at your cost. 10) Any other item not specifically mentioned herein or agreed to by us in writing at a later date is considered to be in your scope. 11) __ ARBITRATION: In case of any dispute or disagreement during the execution of contract matter may be referred to arbitrators Viz. Mentor of Madhucon and CoMADHUCON PROJECTS LIMITED CONTINUATION SHEET 12) ZERO DATE / EFFECTIVE DATE: Zero date or effective date is from the date of receipt of advance payment. 13) SAFETY: M/s.Sujana has to provide separate safety officer to take care of safety at site, All required safety tools and appliances, PPE (personal protective equipment) to be provide by M/s.Sujana to ensure zero accidents. 14) INSURANCE AND STATUATORY REQUIREMENTS: All statutory requirements as per the workmen compensation Act, Minimum wages Act, including insurance for the staff and workers working at site for this purpose alone is M/s.Sujana’s responsibility. 15) OVERALL RESPONSIBILITY: You shall assure overall responsibility for stand-by startup power to our 2x135 MW TPP (Phase-I) on best effort basis. You shall Co-Ordinate with your sub vendors at all stages of project execution to ensure engineering procurement of right materials, good performance & workmanship and timely start up & upkeep of gensets.
