16 Plaintiff Square Enix, Inc. (“Plaintiff”), by and through its attorneys of record,
17 respectfully request a stay of all proceedings for the above referenced case. Plaintiffs have

18 identified the primary “John Doe” defendant responsible for the acts alleged in this action, and

19 have reached a settlement agreement with that Defendant. Under the terms of that settlement

20 agreement, Defendant has until September 1, 2006 to comply with certain conditions.

21 Plaintiff requests that a stay be placed on all pending action until the agreed-upon
22 conditions are satisfied. If the terms of the settlement agreement are satisfied on or before

23 September 1, 2006, Plaintiff intends to dismiss the case voluntarily. If the terms of the
24 agreement are not fulfilled, Plaintiff will proceed with its claims.
