Piney Woods Lumber Company

Date:

The U.S. constitution does not directly protect the right to privacy,
though the communications law does extend some protection.
Martinez filed suit against Piney Woods Lumber Company under the
communications law. His main concern with the invasion of privacy
would most likely fall under the categories of intrusion and the
publication of private facts. Martinez had worked and is currently
working to move away from his past and continue upon his path of
sobriety. It can be argued that the article written set Martinez back in
his journey.
Although the article may have presented Martinez in a negative light
because of his background, Burruss and Haskins had permission to
publish such information. Martinez wrote a binding statement implying
he was aware of the content that was published. Burruss and Haskins
could have been more implicit with the exact nature of the article and
the amount of detail that would be added into Martinez story.
I do not believe that Burruss and Haskins should be liable, because
Martinez granted permission to publish an article.
As a PR specialist, Burruss could have been more honest up front about
the exact nature of the article, which may have influenced Martinez
willingness to give written consent to tell his story. Though a lawsuit is
negative press in itself I think it is important to focus on the fact that
Martinez story is helping many individuals in similar situation to take
steps towards working through their own problems. Martinez story is
also helping to improve overall working conditions and quality of life
for many Piney Woods employees. Ethically speaking, the PR
professional wanted to disclose a personal story to raise awareness,
which isnt necessarily wrong. On the grounds of right to privacy,
Martinez was aware of both the interview and the publication. This
case can be an example of the importance of being honest up front
with all parties to lessen the opportunity for negative press.

Thank you,
Dustin
