physicalactivitiesand/orfacilities(collectively,Activities)atCranmoreMountainResort(Resort),andIacknowledgethat:

TheActivitiesattheResortareinherentlydangerouswithrisksofinjuryanddeathandpropertydamageincludingbutnotlimitedto:
o carelessnessandmisjudgmentsonthepartofparticipantsandResort
o falling,slipping,jolting,jarringorshaking
staff,includingbyfailingtofollowproperprocedures,instructionsand
o unevenand/orslipperygroundortrackconditions,high
theoperatingpoliciesofResort
elevation
o rocks,trees,stumpsandotherformsofforestgrowthordebris
o adverseweatherconditions,naturalelements
o equipmentfailure,malfunction,orimproperuseofequipment
o encounterswithplants,insectsoranimals
o myhealthcondition,physicalexertion,dehydration,fatigue,anxieties
o breaks,sprains,strains,bruisesandothercontusions
andfearsassociatedwithheights,dizziness
o collisionswithotherparticipantsormanmadeornatural
o otherrisksanddangersthatcanreasonablybeinferredfromtheother
objects
risksanddangerslistedhere

TheserisksanddangersareobviousandnecessarytoparticipateintheActivities.

Theremaybeotherrisksnotknownorreasonablyforeseeableatthistime.

HavingaResortemployeepresentdoesnotreducetheamountorseverityoftherisksorhazardsoftheseActivities.

IfIviolateanyResortrulesImayhavemypassrevokedwithoutrefund.

Forsafetypurposes,theareasoftheActivitiesareundervideoandaudiosurveillance.

ImadeavoluntarychoicetoparticipateintheActivitieseventhoughtherearerisksanddangers.
Assumption,Release,Covenant:InconsiderationofthetermsofthisagreementandasanexpressconditionofmyparticipationintheActivities,Ihereby
agree:

toassumealldangersandrisks,inherentorotherwise,ofinjury,deathandpropertydamageresultingfrommyparticipationintheActivitiesatthe
Resort;andrefrainfromrecklessconductthatisnotconsistentwithsafeandprudentparticipationintheActivities,orviolatestheResortsrulesor
thelaw;

nottobringaclaimagainstandagreetoreleaseandforeverdischargeCMResort,LLC;CMRProperties,LLC;CLPLendingI,LLC;Centerplate,their
respectiveemployees,officers,managers,parentcompanies,affiliates,mortgagees,agents,andtheirsuccessorsininterest(collectivelyResort
Parties),fromallliabilityforinjury,death,propertylossanddamagethatresultsfromactivitiesthatareinanywayrelatedtomyparticipationinthe
Activities,theuseoftheResortPartiesequipment,includingallliabilitythatresultsfromthenegligenceoftheResortParties,oranyotherperson
orcause;andallclaimsthatImaynowhaveagainsttheResortParties,orclaimsofwhichIamnotawareorarenotmentionedinthisrelease.This
releaseappliestoclaimsresultingfromanythingwhichhashappeneduptonow;

agreetoindemnifytheResortPartiesfromanyandalllosses,liabilitiesandattorneysfeesresultingfromanyclaimsorsuitsforpersonalinjury,
deathand/orpropertydamagethatariseoutofmyparticipationintheActivities,useoftheequipment,oranyotheractivitiesontheResort,
regardlessofhoworbywhomorbywhatthepersonalinjury,deathand/orpropertydamagewascaused,oranysubrogationorderivativeclaims
broughtbyanythirdpartyorinsurerforinjuryordamageImaycause;

thatthisagreementislegallybindingonme,myheirs,executors,administratorsandassigns;isgovernedbythelawsoftheCommonwealthof
Massachusetts;andwillbeinterpretedtoprovideasbroadandinclusiveareleaseofliabilityasislegallypermissible,butitisnotintendedtoassert
anyclaimsordefensesthatareprohibitedbylaw;

tograntexclusivepermissiontotheResortPartiestousemyimage(s)forthepurposeofpublicity,publicrelations,editorial,orotheradvertising
purposeswithoutrestrictionastofrequencyorduration

thatexclusivejurisdictionandvenueforanylegalactionagainsttheResortPartiesisinSuperiorCourtofCarrollCounty,NewHampshireorthe
federalcourtsoftheDistrictofNewHampshireandthosecourtshavepersonaljurisdiction;

thattheResortPartiesaregrantingmepermissiontousetheResort,theirfacilities,andequipmentinexchangeformesigningthisagreement;and
thatthisagreementwillsurviveandcontinueinforcebeyondtheendofthecurrentActivitiesseasonwithrespecttoanyliability,injuryordamage

occurringbeforethattime.

indemnifytheResortPartiesifanyclaimisinstitutedagainstthemasaresultofanyinjuryordeatharisingoutof,relatingto,orinanywayconnectedwith
theMinor(s)sparticipationintheActivitiesorpresenceontheResort.
