NOTICE OF INTENT TO CIRCULATE INITIATIVE PETITION
IN THE CITY OF ARCADIA

To The Clerk of the City of Arcadia:
Notice is hereby given by the persons whose names appear hereon of their intention to circulate
the attached petition within the City of Arcadia for the purpose of setting a limit of square footage
for new homes in single family residential zones.
Whereas the character, quality and appeal of the single family residential neighborhoods in
‘Arcadia is being destroyed by new home construction that is neither compatible nor harmonious
with surrounding homes because of their size, the residents of Arcadia have drafted a Ballot
Initiative to remedy this situation. This Ballot Initiative proposes to establish standards for new
development with the intent to protect the character of the neighborhood, preserve the privacy
and views of residents and maintain property values in Arcadia.
Pursuant to applicable provisions of law, we respectfully request that you immediately deliver this
notice to the City Attorney and that he prepare a Title and Summary within the time prescribed by

Pursuant to California Elections Code Section 9201, we the undersigned, registered qualified
voters of the City of Arcadia, County of Los Angeles, California, hereby propose the following
initiative ordinance and petition you to submit it to the City Council of the City of Arcadia for
adoption without change, or for submission to the voters of the City at a general election, unless
signatures equal to or in excess of 15% of the registered voters of the City are submitted, in
which case if the City Council does not immediately adopt this ordinance without change, we
petition you to submit this ordinance to the voters at a special election called according to law.
‘THE FULL TEXT OF THE ORDINANCE IS AS FOLLOWS:
The people of the City of Arcadia do hereby ordain as follows:
SECTION I. PURPOSE AND FINDINGS
‘A. The purpose and intent of this ordinance is to add to the City of Arcadia Municipal
Code for single family residential zoning a limit on the amount of square footage of new homes
in order to create harmony and compatibility with existing homes.
B. The character of single family residential neighborhoods in Arcadia is defined by
expansive lots with predominantly single story, modest sized homes.
C. The “building envelope” created by the current single family residential zoning codes
allows for new homes to be too large and out of scale and proportion to existing homes.
D. Single family residential homes that are out of scale and proportion to existing homes
are not harmonious and compatible.
E. Two story homes in single family residential zones are more likely to take away from
the views and privacy of neighboring properties.
F. The intent of the ordinance is not to prohibit two story homes but to incentivize the
building of single story homes which are less intrusive on neighboring properties and more
compatible and harmonious with the neighborhoods of Arcadia.
G. The purpose of allowing less square footage for two story homes is to reduce the
likelihood of the new homes obstructing views, invading privacy and appearing out of scale and
proportion to the neighborhood.

To achieve the purpose of this ordinance, the City of Arcadia Municipal Code is hereby
amended by the addition of Chapter 9 to Article IX, thereto, reading in its entirety as follows:
Chapter 9: ALLOWABLE GROSS FLOOR AREA
9900 Definitions.
Gross Floor Area shall mean the total square footage of a dwelling unit including the sum
of the total surface area enclosed by the walls of the first and second floor, including any storage,
covered patio, covered porch, carport, accessory dwelling unit and garage excluding 400 square
feet of any attached garage on a lot less than 19,999 square feet and 600 square feet on any
detached garage on a lot over 20,000 square feet.
9901 Allowable Gross Floor Area
All buildings in the R-1 and R-O zones shall be limited to a maximum gross floor area of
35% of lot square footage for lots up to 10,000 square feet, plus an additional 15% of the lot
square footage over 10,000 square feet, plus an additional 5% of the gross square footage
calculated on the lot square footage for a dwelling unit that is single story.
9902 Calculating Square Footage of Rooms With Ceiling Heights Over 15 Feet
Any and all square footage of space with ceilings over 15 feet tall shall count as double the
square footage for calculating allowable gross floor area.
9903 Limit On Basements
Basements shall not exceed 30% of the first floor footprint or 1,500 square feet whichever is
less. 50% of the square footage of basements shall be counted towards the allowable gross floor
area.
9904 Garage Requirement
Single Family Residences of 5,000 allowable gross floor area square footage or greater shall
require a 3 car garage.

Building Height shall be defined as the vertical distance measured from the top point of the
proposed building to the lowest point of any proposed exterior wall of the structure, including
any exposed basement walls.

BUILDING HEIGHT.:
If Lot Width is less than 75 feet, then maximum dwelling unit height shall not exceed 25
feet. If Lot Width is 75- 84 feet, then dwelling unit height shall not exceed 26 feet maximum. If
Lot Width is 85-94 feet, then dwelling unit height shall not exceed 27 feet. If Lot Width is 95-
104 feet, then dwelling unit height shall not exceed 28 feet. If Lot Width is 105-114 feet, then
dwelling unit height shall not exceed 29 feet. If Lot Width is 115 feet or greater, then dwelling
unit height shall not exceed 30 feet.
I. IMPLEMENTATION
A. Onthe effective date of this initiative measure as provided by California law (the
“Effective Date”), all provisions of the foregoing ordinance set forth in Section II of this
initiative measure are inserted into and become part of the City of Arcadia Municipal Code.
B. _ No provision of the City of Arcadia Municipal Code that is inconsistent with this
initiative measure shall be enforced after the Effective Date.
SECTION IV. AMENDMENT AND REPEAL
In accordance with California Elections Code Section 9217, this ordinance and all of its
provisions may be amended or repealed only by a majority vote of the electorate, Modifications
of these code sections shall be prohibited.
SECTION V. __ SEVERABILITY
If any portion of this ordinance is hereafter determined to be invalid by a court of competent
jurisdiction, all remaining portions of this ordinance shall remain in full force and effect. Each
section, subsection, sentence, phrase, part or portion of this ordinance would have been adopted
and passed irrespective of the fact that any one or more sections, subsections, sentences, phrases,
parts or portions be declared invalid or unconstitutional.
SECTION VI. INTERPRETATION
In interpreting this ordinance or resolving any ambiguity thereof, the City Council and all other
City of Arcadia entities charged with implementing or enforcing this ordinance or any part of it,
as well as any reviewing court, shall interpret this ordinance in the manner which most
vigorously and effectively accomplishes its purposes and operative provisions.
