Chapter 119 and Ordinance 5781contain the same problems and dangers- they are the same in
essence. Both laws demand that businesses allow men to enter female bathrooms, locker rooms,
showers, and shelters. Under both laws, local businesses are subject to uncertain volatile
environments that expose them to unacceptable risks. Each of the laws discriminates and
persecutes people of faith by not allowing them the freedom to exercise their religion.
They also have the same proponents: Adella Gray, Matthew Petty, Sarah Marsh, Mark Kinion,
Alan Long, Lioneld Jordan, Don Marr, Kit Williams, Blake Pennington, Kyle Smith, Laura
Phillips, Danielle Weatherby, For Fayetteville, Center for Equality, Keep Fayetteville Fair, HRC,
and others. All of these people have been involved in Chapter 119 and Ordinance 5781. All of
these types of laws started with HRC (Human Rights Campaign) founded by Terry Bean. The
essence of these laws is to elevate sexual behavior into a position where it is endorsed by a
community and given a special status. These individuals are pretending that these two laws are
different and that HRC has distanced themselves from their campaign. This is a campaign ploy to
deceive voters.
Since the proponents were more than glad last year to partner with HRC and defended HRC and
tried to ignore Terry Beans involvement in sex with a minor. They defended Chapter 119
vigorously and never admitted that it was bad for Fayetteville. In a NWA Letter to the Editor,
Adella Gray, Danielle Weatherby, and Kyle Smith began with, Last year, the HRC spearheaded
an attempt to pass what was known as
Chapter 119... That effort failed because a
cookie-cutter ordinance written by
national advocates in Washington, D.C.

We created a substantially different
ordinance Its true that HRC
spearheaded that attempt and paid almost
$300k for the campaign- glad they finally
admitted it. Its not true that the effort
failed because it was a cookie-cutter
ordinance because it was actually tailored
by a collaboration of HRC, city attorney, city council members, and members of Center for
Equality specifically for Fayetteville. The reason it failed is because the citizens of Fayetteville
did not like the substance of Chapter 119 and made a extraordinary effort to repeal it. Its
disingenuous for the proponents of Chapter 119 to distance themselves from that ordinance and
HRC now that they have embarked on their remake of Chapter 119 called Ordinance 5781. Both
ordinances create discrimination against businesses, women and children, and people of faith.
It is highly unbelievable to think that HRC does not support this ordinance when it has
everything that they have pushed for across the country. There are greater religious exemptions
in similar laws HRC has introduced and funded. They will take whatever they can get. For

example in Houston, pastors were exempted from performing same-sex weddings. Ordinance
5781 offers no such exemption. Therefore, the claim that HRC is not involved in this go around
is absurd. Even though the first financial filing of the ballot question committee, For Fayetteville,
does not list campaign contributions from HRC that does not mean they wont give later and
doesnt prove somehow that they dont like this ordinance and dont want it passed. Looking
around the country there are many shapes and sizes of these laws and they all contain the same
controversial and divisive issues.
It is impossible for a rational person to think that Adella Gray, who enthusiastically supported all
aspects of Chapter 119 and didnt criticize it at all during the entire process would now claim
that it was, not right for our city. Adella, was happy to tie herself with HRC and never
condemned Terry Bean last fall, but now she is trying to distance herself. Could it be that she
doesnt want anyone to know that in her run-off election HRC gave her $2000 which was the
largest contribution of her campaign- 37.7% of all contributions. This was the only city council
race HRC gave to in Arkansas. Why would HRC do that for Adella? Was it a pay-off for
supporting Chapter 119? Was it to keep Paul Phaneuf from being on the city council since he
opposed their agenda? Or was HRC looking to the future in case Chapter 119 was repealed? In
any case, its pure logic that HRC wanted her to continue working for their agenda- and here it is,
Ordinance 5781, the remake of Chapter 119. HRC and Adella Gray are tied together. Follow the
money.
