The children’s lifetime home in Modesto is being sold by their father (per the order served to me) and as the primary caretaker I am creating a new, safe and stable home environ- ment for them in Visalia 4. Both children were changing Modesto schools this year so itis the right time to enroll them in school in Visalia with minimal impact 5. Relevant background information below on safety concems for myself and my children Specific argument by respondent regarding school enrollment for children I moved to Visalia after providing Greg with 45 day notice right after the last economic hearing on June 18, 2012 at which I did not receive the corrective adjustment to my support Payments so they are consistent with the court ordered temporary guideline support. It was im- mediately evident that I would not be able to continue paying legal fees, rent, utilities, food, clothing, living expenses and medical bills for myself and children I was also gravely concerned for my personal safety in regard to Greg’s aggression and attacks on me and the well being of my children, On Friday, Aug 3rd my previous attorney, Paul Fromson notified me that there was an emergency order prohibiting me from enrolling my daughters in school outside of Stanislaus (If the item that this Attachment concems is made under Page 3 of 24 penalty of perjury, all statements in this Attachment are made under penalty of perjury.) At the time of the notification I had already relocated my residence to Visalia California. As the court designated Primary Caretaker for my two minor daughters I felt it would be cruel and detrimental to enroll them in school in Stanislas County for the two weeks pending the hearing to determine custody and school enrollment issues. School in Visalia was not scheduled to start so I saw no problem in that the kids would not be missing any school. I specifically de- termined to let the girls avoid starting school in Modesto and making friends for two weeks and then leaving to attend school in Visalia where I now live. On Wednesday Aug. 8th, Greg's visitation day with the children and the day after school started in Stanislaus County, Greg enrolled and sent my two Daughters to school in Stanislaus County without informing, discussing nor seeking permission from me as the Primary Caretaker. Because he sent the kids to school they were unavailable for pick up by me at the designated 2:00 PM exchange time on Thursday per the custody order. In fact, Greg kept the children for the remainder of the week and continued sending them to school. Further, the children were extremely confused and upset that they didn’t understand why they were now attending school in Modesto and whether they would now have to leave in a cou- ple weeks and attend school in Visalia. When I indicated that they would in fact not be going back to school in Modesto they were angry with me. Per Mike Goss’s letter to my previous attorney (Paul Fromson) dated Aug 9th, 2012 Mr. Goss told my attorney to inform me that my children MUST attend school where the father had enrolled them pending the next custody hearing. There is no such order made by the court - yet another attempt by opposing counsel to impose unilateral control and intimidate the Respondent. Please see Exhibit T Attached - Letter from Mike Goss to Paul Fromson 8 - 7 - 2012 The following is clear: Mr. Goss is attempting to create “precedence” that the girls are currently attending school in Modesto and will argue at the hearing that they should remain in school in Modesto. I find Mr. Goss’s strategy unethical and contrary to the written orders and implied intent of the court custody order for the following reasons: Mr. Goss’s strategy actively encourages parental alienation by encouraging his client to enroll the minors in school after the Primary Caretaker has informed the children that they will not be attending school until the court makes a determination. Their mother has 72% custody and has relocated to Visalia and has remained in full compliance with the existing custody order and all other orders of the court. Mr. Goss’s strategy of creating precedence of having the girls enrolled in school by their father is in direct violation of the custody order in that he enrolled them unilaterally without noti (if the item that this Attachment concerns is made under Page 5 of 24 penalty of perjury, all statements in this Attachment are made under penalty of perjury.) I will not take them out of school only to have him send them back during his visitation day and get caught in Mr. Goss’s cruel trap that amounts to child abuse. These acts included instructing me to strip naked at his direc- tion, allowing him to blindfold me an tie me up with extremely detailed knotting. Once bound and blindfolded Greg walked me outside and hung me from a tree limb or post by draping my bound hands across the limb or the post. I hung naked and exposed outside for 5 to 6 hours cry- ing and begging for him to cut me down. On other occasions Greg bound me to a chair and posi- tioned me in front a television screen - when he removed the blindfold a movie of bondage and sexual torture was playing. Greg never discussed, explained nor apologized for these incidents. Two weeks after the first incident I lost my ability to speak and was committed to a mental health facility in Fresno, California for one month. While continuing to hold me by both hands he forced me to the ground which was excruciating and debilitating from the pain of the Cone Biopsy. Greg often grabbed my wrists and twisted them because he knew I was recovering from a a recent surgery to treat carpal tunnel syndrome in both wrists. Once he forced me to the ground he sat on my chest (Greg is over 300 LBS). At this time we were in the entry way by the front door and I bit Greg again but he would not get off of me. At that time I reached out and grabbed an umbrella that was laying on the floor in the entry way and began to hit Greg with it and telling him to get off. I be- lieve this is the incident that he attempted to represent in his declaration for a restraining order and that he mistakenly claimed it occurred on July 6th instead of July 7th. I was in pain and still bleeding, additionally, I was suffering from a badder infection. At approximately 4 AM Greg in- sisted I take 2 Zanax and 2 Hydrocodone. At approximately 8AM Greg came into the bedroom and insisted I meet a visitor at the front door. I said I could not. Greg then informed me I had flowers at the door for me. I again said I could not go to the door. Immediately thereafter a strange man entered my bedroom while I was heavily sedated and still bleeding from my prior surgery with nothing covering my lower extremities. The man produced a document and indi- cated I was being served divorce papers which included a restraining order with five minutes to leave stipulation. I was escorted out of the house by the police with a suitcase and directed to my car and I drove away while under the influence of Zanax and Hydrocodone while still bleeding. Greg stood in the comer of my room during the entire process with a look on his face similar to ‘what encountered when I would discover him masturbating to violent pornography in common areas of the house. ‘Two days after the five minute kick out from my home and separation from my children, I received the results of the Cone Biopsy indicating I had cancer and required surgery to remove my cervix, ovaries and uterus. That day Greg also allowed me a five minute visit with my chil- dren and said I would not be allowed to see them again for six weeks. At this point I was completely demoralized, shattered and hopeless. Later that day I drove to Visalia and attempted suicide. I was rescued by my parents after they were contacted by my adult son in Florida who was worried about me. I was in recovery for one week after being released from Kaweah Delta Hospital in Visalia approximately July 20, 2011. ‘Two weeks after my surgery to remove my cervix, uterus and ovaries to avoid cancer com- plications, I developed severe and painful vaginal sores. These were immediately diagnosed as Herpes Simplex 1. I was shocked as I had only had sexual relations that included oral sex with Greg. The doctors educated me that the stress of the surgery had led to the outbreak but that the Herpes had been present since it was contracted through oral sex with a partner who had the Herpes Simplex 1 cold sore at some time. | immediately asked Greg and he said that he was in fact aware that he had Herpes Simplex 1. Further, as a medical doctor he was aware that the disease was transmitted via oral sex and that he was aware that he had informed me that he had the disease but that it could not possibly be transmitted to me - even knowing he had performed oral sex on me and understanding the potential harm he may have inflicted upon me without my knowledge. Greg accepted responsibility and paid for the first two prescriptions of Valtrex, a drug that controls the outbreak of the disease. During the course of the divorce proceedings over the last year there have been a number of maneuverings and incidents based on actions by Greg and his attomey Mike Goss that have been cruel, demeaning and procedurally unusual in the unilateral nature of the negative impacts on me. Specifically i have endured the following strategic actions to diminish my financial re- sources and peace of mind: 1. was removed from my house at the onset of the divorce with a highly unusual "S min- ute to leave" restraining order that was not supported by any police report or medical report. It was complete hearsay and contained falsehoods and fabrications. See Attachment Exhibit L - Photo of bruise on cheek 2. I was recovering from a biopsy and restricted to bed rest and heavy pain medication. I ‘was not given access to any community resources, money nor personal assets from the house. Greg specifically chose the moment to have the divorce and "5 minute to leave" order served. 3. From the kick out from my home on July 13th, 2012 through my hysterectomy surgery on October 12, 2012 and for eight weeks of recovery from major invasive surgery thereafter, dates upon which I was in court for important matters in my divorce, I was under Doctor's care including prescribed doses of antibiotics, narcotic pain killers, valium for stress and Xanax for anxiety. 5. The divorce strategy employed by Mr. Goss and Greg is exactly the one he described to me when I had a 22 minute pre-engagement conference with him one year prior to Greg hiring him - only he is executing it on me rather than Greg because | felt it was too aggressive and un- ethical and decided against hiring him. I don't know why he has been allowed to represent Greg in light of the obvious conflict of interest. Especially since I was not able to hire any divorce at- tomey I contacted in Modesto, Stockton or Merced because my husband had spent the last two years contacting all of them to create a conflict of interest that precluded them from representing. me once I contacted them. Equitable application of the law would have Mr. Goss removed from representing Greg - OR - allow me to use one of the competent local divorce attomney’s that are currently afraid of the conflict of interest issue to which Mr. Goss appears to be immune. Normally, if the petitioner was requesting a greater percentage of physical custody and to become the Primary Caretaker, it would follow that there would be a request to reduce the amount the Petitioner pay’ in child support relative to the requested change in custody percent- age. The fact that there is no request to modify support would indicate that the Petitioner is aware that he is not currently paying the correct amount of child support per the existing order and does not want to bring attention to that issue as he would not be expecting to reduce the required payment by increasing his custody percentage because his current payments are already too low. Existing Child Support & Spousal Support Error The existing court order indicates I should be receiving guideline support. See Exhibit V - Order to Show Cause - SEPT 9, 2012 Per the current order, guideline support should be calculated according to the following factors that were accurate at the time the order was made: Petitioner Income: $40,000.00 Number of Minors: 2 Percentage Custody: 10% I would like to receive the amount as ordered by the court and receive the difference retroac- tively for incorrect amounts I have received to date. I would like to receive my payments elec- tronically since the Petitioner regularly refuses to make the payments to me in a timely manner and uses them as a means to control me and make me request the payments repeatedly - extend- ing the cycle of abuse and control as he did in the marriage.
