juridical capacity under the
following conditions:
1. for matters which are
favorable to it
2. birth later under the
conditions laid down in
Arts. 40-41. (passive
beginning)

Restrictions

Fetuses with intra-uterine life for 7


months or more: just have to be
alive at the time of complete
separation from the womb
Fetuses with intra-uterine life of less
than 7 months must be alive for at
least 24 hours from the time of
complete separation from the
maternal womb.
Complete separation from the
womb is when the umbilical cord is
cut
