Re: Delivery of defective air cooling units; and failure to complete the project scope on
March 15, 2015
Dear Mr. ADIT,
This letter is pursuant to our agreement that your company will supply, deliver, and
installation of data center solutions for the Data Center Project of our company AO
Corporation in consideration of P1,200,00.00. However, your company delivered air
cooling units which are not functioning and your companys failure to complete the said
project within the agreed date of completion which is last 15 March 2015. It is expressly
stipulated in the contract our companies have both signed that there shall be payment for
liquidated damages equal to 3% of the total amount of consideration per day of delay,
but shall not exceed 20% of said consideration.
Your failure to perform obligations in the contract mentioned above amounts to a breach
of contract and our company is therefore entitled to recover damages.
I will expect a response to this letter no later than 30 August 2015. If this matter is not
resolved by the time specified above, I reserve the right to commence legal proceedings
to recover damages without further notice to you and this letter may be tendered in court
as evidence of your failure to comply in the contract.
