They reported that the male, wearing a green shirt and in his mid 40's, was stumbling and when they approached his Jeep to ask him not to drive he gave them the peace sign and ignored them, arrived at approx. 930 pm and located the described vehicle with a man inside that tthe description. The male, James Porter, also the registered ovmer of the vehicle, was sitting in tho driver's seat. His face was red his eyes bloodshot and there was a strong smell of alcohol emanating from the Jeep expleined to him why Twas there and that was concemed he was going to drive. His speech was very slurred, he stated that his keys were in his pocket, His car ‘was not running, L asked him if [could drive him home or get hima a cab and he sai no. I old hima not to drive. | then went tothe movie box office and told the employee to call 911 ifhe saw the Jeep leave. At approx. 11:00 pm dispatch advised that the manager at Regal Cinemas, Holly Westbrook, had reported thatthe Jeep ‘had left the parking lot. Officer Com went out to Porter's residence. [called Westbrook, She stated that neither her or the employee working in the boxoffice had witnessed the Jeep actually drive off. At approximately 2125 hours myself, Officers Branes and Keller were dispatched toa reported DUT atthe Regel Cinemas located at 750 NW Bavard Street, The caller was requesting contact and dispatch advise that there was avery intoxicated male siting na sliver Jeep with License AUZOSS1. They advised the vehicle was not running and deseribed inthe parking lot where it was. ‘They advised thatthe male was white, 4Sish, wearing a greon shirt and khaki pats. In the CAD detail it read "MALE. WAS STUMBLING, WEAVING OTHER CUSTOMERS REPORTED HIM INTOX TOO RP APPROACHED THE. \VEH TO ASK HIM NOT TO DRIVE MALE HELD UP A PEACE SIGN AND IGNORED HER". Officer Branes and Officer Honsen arrived in the area prior to me. I drove through the parking lot but never saw the diver. Officer Branes had already made contacted and advised me that he said ke won't drive and would not take her up on a cab or arride home. She said that he was very intoxicated, but the keys weren't inthe ignition therefore no ctime was being committed. She also stated that he refused to give identification, I looked up James Porter in ILBADS in an attempt to identify the driver and check for wants or warrants in hopes of forcing hi to take a ide. I found nothing that matched so we cleared. At approximately 2357 hours dispatch advised that an employee of tho toate called back and stated thatthe jeep had left. By this time I had Reserve Officer Joshua Krebs riding along with me, ‘old im about the earlier incident atthe theater and due tothe level of intoxication on the driver Iwas concerned about him making it home. I told him we ‘were going to go check the route to ensure he did not crash somewhere, asked CenCom what address the car was registred to and they told me 3055 NW Colonial Lane. We drove th route to this address. The address was atthe very end ofa culdesac. As we got clase I could see the Jeep backed in and there was a person inthe driver's seat. [could see the head of the person bobbing consistent with someone who isin an altered state, I noticed a green police car parked nex tothe Jeep. Officer Krebs asked me it could bea deputy, At this point I remembered thatthe name on the registration was James Porte Ihave known Sheriff's Office "Employee Jim Porter for approximately 18 years and have only known him as Jim soit dd not click with me who's vehicle it was until I saw the police car. I then was hopeful it may be a relative or son who had the car, ‘As Lapproached I shined my flashlight nthe Jeep and found that it was the Jim Porter I knew. Hl eyes were staring off, like a thousand yard stare, Ho did not lok lke himself, he appeared out oft. There was vomit on his chin, arm, ‘chest and lap. I asked him if he was ok and he said "Yah". It was clear to me that he was severely impaired. I requested a county supervisor respond. He opened the door and I again asked him ithe was ok again and he said "Yah. Tasked again what was going on and he pat his hand up and motioned and said in avery low weak voice "Bed". [told him was going to need him to hang ‘out and he shook his head and said "No". He then said "Go away". Itold him could not do that. I then asked him ‘hy he didn’t lt the officer dive him home earlier and he said nothing, {asked him what was going on again, 381 hhave known this man fora very long time and this was extremely out of character, and he said nothing, 1 asked him to help me out here, and he shook his head and said "I know, Lexplained why I was thereto check on him to make sure ‘this car made it home. Itold him I wished [hadn't bt that I was stuck and he told me "No,your not stuck", [told him was because someone saw him drive out of there, and I inquired if there were personel problems going on and he said "No". ‘As we waited for the KCSO supervisor we didn’t talk much. I said under my breath "God dang it" and he seid "Were ‘200d Jen’, [told him I wish we were but wo weren't. CenCom advised me thet $020 was enroute and T acknowledged and asked for an BTA. After significant delay he looked at me and said "For what". I said for someone ese to come here. He took in a deep breath, leaned forward and said "“Jenvere good. I again sad were not though. Told bim I ‘wished we were and told him to hang tight and try to relax. Talso asked that Chef Townsend to respond. Porter heard that as well and looked at me and said "Really"? I looked at him and told him tha didn't know what to do here, He started to get out of the oar. [asked him to stay in and he did, Isaid "Your drunk" and he said "Yah", real low and hhardly understandable, [then said “and you just drove here from the theater." He acknowledged and said something about 2 miles that couldn't understand. Tasked him what ho expected me to do here and he said something else ‘unintelligible. I told him that I hoped there was nothing legally that would stck here, implying tha I did not want to arrest him orto have anything happen to him. He then pot out ofthe car. Tried totalk him into staying in but he ‘wouldn't and I wasn’t going to posh it. 1 informed him that he was not going ito the house. [asked him where he was at earlier and he sai the movies. [asked him if he worked today and he said "No", I told hhim we had to wait until a supervisor arrived. He sighed as if this was upsctting, We talked abit more. He reeched {nto is pockets so I asked him if it was only keys in his pocket and he put up hs hands and I pated him for weapons. Sergeant Dickson asked mie over the air what kind of response I needed and I told bim litle more than routine. Porter looked at me again and said "Really"? [told him that f just wanted to get this over with told him I wasn’t scared of ‘him or anything, but wanted to expedite what needed to happen if anything, Talso told him how upsetting this wes to me, to be in this situation with him, Porter asked what we were doing and I told him that we were waiting for my boss. He then got into his Jeep and grabbed his phone, He then stumbled around a bit and said something like goodnight, or have a good night and waved, then started walking towards the front door of the residence. I said "No" and grabbed his left arm. I told him he could not go anywhere, I then pleaded with him to just relax and sit down on the pus bars ofthe ca. He pulled away fom ‘me a bit but eventually stopped and stood stil again. During the entire approach and contact was wearing my issued body camera which was recording. Shortly after Sergeant Dickson arrived and he was briefed as well. I advised thom that his keys were in his hands, not in tho ignition, and that the ‘vehicle was not running when {arived. I described the condition he was in, ore word answers, ees staring off, the vomit, and his mannerisms, I told them that I thought I could smell alcohol bu the odor of the vomit was ‘overwhelming and T couldn’ tll for sure. Tcould only tell that there was defisite impairment. [had reasonable suspicion of DUI but I did not have probable cause to make an arrest. Thad not called the theater as I id not want to leave the brand new Reserve Officer alone. ‘After a few minutes Chief Townsend called for me to walk back to him which Idd. Officer Krebs remained with Porter while we talked, I was asked ifthe impairment could be medication and could not tell for suo. I thought possibly a mixture ofthe two. . [told them that was worried about him since this was not a behavior I would ever ‘expect from Porter. [returmed to Porter and told him that I wanted tobe straight with him and told him that we had the reasonable suspicion to detain him but did not have probable cause for his arrest. [told her that if Jim ‘wanted her there she could and he asked her to go back inside. Sergeant Dickson spoke to the manager ofthe theater and she did not see Porter driving the vehicle, only the vehicle leaving, ‘There was no probable cause for his arrest. returned to my vehicle and waited for Sergeant Dixon to talkto Porter then cleared the scene. At around 2357 we received a call about a silver jeep leaving the movie theater with a suspected drunk driver. Oficer Cor informed me that sho had carlier been briefly at the movie theater with Officer Danielle Branes, where « RP had reported a man suring and staggering nea his jeep, and that the man had refused to provide ID or accept assistance from Officer Branes. Officer Com commented that it could be a drunk driver and ifso they may have wrecked somewhere on the way home so we decided to drive to Clear Creek road in an effort to see if we could find the jeep and possibly drunk driver. CenCom advised thatthe registered owner lived on Colonial Lane. As we tured northvest on NW Finn Hill oad, we saw a ‘white four door jeep, and Officer Comm informed me that wo were looking for atwo-doorjep, and confirmed thatthe ‘one we were looking for was silver. We continued on NW Fin Hill road and tumed west onto NW Rude Road until we got to Clear Creek road NW where we tured South, Driving south we looked forthe silver jeep both on and off the road, but did not seo it anywhere, We continued on Clear Creek until we passed colonial ane and almost immeditly tured around and drove east on Colonial Lane to the end ofthe street. We stopped approximately thirty yards away fom the house at the end ofthe street (3055 NW Colonial Ln) where from the light of our headlights, we observed four parked vehicles- two to the north side of the house and two in front of the garage area of the house. From north to south the vehicles were a silver two-door jeep wrangler (which was backed in), a green sheriff's crown Victotia type patrol cr, a blue ford ranger, and 8 grayish colored Toyota corolla. I immediately noticed that inthe jeep there wasa white male whose head was slowly, but pronouncedly bobbing. His head appeared to be dropping towards he steriag wheel and then would abruptly lift up again. Thinking we had found the suspect vehicle I stated that was a silver jep, and I asked Officer ‘Com ifshe thought the driver inthe jeep was a sheriff. Officer Com said something to the effect of it could be, but hhoped not. We exited our vehicle and approached the silver jeep. Officer Com took a more direct approach to the Joep. [thought that maybe the driver was sheriff, and could be armed, and under the influence, so I believe [said something tothe effect of bo careful to Officer Com, and I walked slowly behind her and [tied to us the ford Ranger as cover. Seeing officer Corn approach the vehicle with her flashlight tumed on the occupant ofthe jeep, I moved toward the front of the jeep and turmed my flashlight on the occupant, 1 immediately noticed thatthe occupant was a white male, appeared tobe in his mid to late 50s, with a military-type haircut, and a mustache, He was wearing an olive-green colored t-shirt with an underarmor logo and some small yellow-colored accent ries on some seam areas. He was ‘wearing blue jeans. What immediately attracted my attention was thatthe man had wet vomit on his shirt and hs ight ‘arm. His eyes did not appear normal - they appeared to be glazed and he seemed to be gazing off in the distance, even when he looked at me and Officer Com. Officer Com asked Jim ifhe ‘was ok and he suid yes. Officer Com requested a county supervisor. She asked lim what he was doing, and he ssid "bed", Officer Com seemed upset about the situation. Jim opened the door tothe jeep and said to "go away” and gestured with three fingers slowly in a down to up type gesture. Officer Com said she wished she could, but that we could not. When Jim opened the door, I noticed tho smell of what appeared tobe alcohol mixed with vomit. (Officer Corm asked if Jim was armed, and he responded that he was not. While we waited there, Jim asked if was a reserve officer and sad I did a good job. He told Jen several times that "we are good, to which Officer Com responded with lines tothe effect of "no wo aren't’, and "E wish we were" Jim kept glancing at Officer Com's video ‘camera and told us to "go". Officer Cor reiterated several time tat she wished she was nt there, that she wished we could leave, but thet we could not do so. Officer Com requested an ETA (which we were told would be fifteen ‘mimutes), and that appeared to pique Jim's interest. Jim acted annoyed several times by my flashlight and asked me to lower ita couple of times, and asked me to tur it off. Jim started to try to exit the vehicle, but Officer Com told him he could not do so. Officer Com ultimately allowed Jim to get out of the jeep. He reached back infor his keys and thereafter stood in front of the sheriff's patrol car. After Jim put his hands into his pockets a fow times, Officer Com asked ifthe had any ‘weapons and quickly patted around his pockets, but did not find any weapons. Officer Cor mentioned that Jim was a bad ass a couple times, in a complimenting manner, He seemed more unhappy afer that: We stood there for several ‘minutes and officer Com made small talk, including multiple comments about how she wished this was not happening. ‘She said to Jim at one point that he was drunk and that he drove from the theater, he sad yes to the first comment, and "2 miles" to the second, Officer Corn commented that she hoped nothing would come ofthis, but that ethically we had to do our job. At one point Jim tried to walk toward the house (I beliove he sid te said "goodnight") but Officer Corn insisted that he stay in font of the Sheriffs car and stepped in front of him and directed him back to the font ofthe patrol car. She offered fo have him sit onthe bar onthe front ofthe patrol car. Jim declined, and continued to stand, ‘Approximately 15 to 20 minutes after we had arrived, our chief arrived. Our chef approached and stood with s fora ‘ew minutes, ‘Then he and Officer Com went back to the parked LEO vehicles and confared. A sheriffs sergeant arrived as well and conferred with them. I stayed standing with Jim, At one point Officer Com walked back and told ‘Tim that we had reasonable suspicion to detain him and that we would be detaining him fora ltl bt longer. We stood there for soveral minutes while Jim told both Officer Com and Ito breathe and relax. Jim's wife came out and asked ‘hat was going on, and Officer Com directed her back into the house, saying that we would let her know what s going, om in a few minutes. ‘A few minutes later Officer Com walked back to the LEO vehicles withthe sherf's sergeant and our chief and they talked for several minutes while I stood with Jim. Jim told me to relax several times. I continued fo stand with Jim ‘until the sheriff's sergeant seid I could go back with "my partner." He then escorted Jimto im's wit onthe porch of the house, and ater speaking with them fora few minutes, allowed Jim and Jim's wife to go into their home, The entire cal took approximately one hour.
