TheCarwashTaskforcemetforthesecondtimeonWednesday,January13,2016tocontinue
addressingquestionsandconcernsregardingtheimpactupontheneighborhood.Atourfirstmeetinga
significantamountofinformationwassharedbyGleam.Atthismeetingweprimarilytriedtoaddress
threeissues:1)theenforceabilityandusefulnessofaGoodNeighborAgreement(GNA)withinthis
specificcontext,2)Queuing,ingressandegressalongWolffandXavier,and3)Gleamemployeeparking.

GoodNeighborAgreement
1. Hasawiderangeofapplicationsfromrezoningstoliquorlicenses.Inthisinstance,thecarwash
isausebyrightsotheenforcementcomponentoftheGNAcannotrelyupontheCityformore
traditionalmethodsofenforcement.
2. IfaGNAiswrittenasacontract,theremaybelegaloptionsforenforceability.However,ittakes
moneytohavethepartiesattorneysreviewaGNA;italsotakesmoneytoenforceaGNA
throughthelegalsystemandthisisnotadesiredresultforanyofthepartiesinvolved.GNAs
craftedinthismannercanincludetransferabilitytonewownersshouldthebusinessbesoldin
thefutureand/orberecordedwiththedeedofsalewiththecounty.Clausescanbeaddedto
addressnewissuesastheyarisethroughagoodfaitheffortinthefuture.Additionally,
componentscanbeaddedtoensurecompliancethroughperiodicmeetingsorcheckins
betweentheparties.
3. GNAsarefiledwiththeCounciloffice,whichprovidesknowledgetotheCityandmayprovide
morescrutinyfromtheCityinspecificareasoutlinedintheGNA.TheymayalsobeusedbyCity
Council,PermitOfficeorTrafficEnforcementasapointofreference.
4. However,theTaskforcediscussedthatinthisinstanceaGNAmaybejustanopportunityto
expressthegoodwillandintentofallpartiesandthattheywillactingoodfaithtokeepthe
promisesandexpectationsoutlinedinthisspecificGNA.
5. MikeBeasley,anofficerandboardmemberofBerkeleyRegisUnitedNeighbors(BRUN)
explainedthattheBRUNboardwaswatchingthisprocesscarefullyandhopingtousethis
approachtoaGNAinotherplaceswithintheirneighborhoodwhereneighborsandbusinesses
wereinvolvedbutnotnecessarilyinalicensingorrezoningcontext.
6. WeagreedtoworkdiligentlytoensuretheGNAiscomplete,thatitexpressestheintentofall
thepartiesandisasenforceableaspossible.
7. BRUNwillneedtobeasignatorytotheGNA,aswillGleam.Wediscussedthepossibilitythat
individualneighborsmightbesignatoriestoaGNA.
8. ThereisnospecificrequirementastowhosignsaGNAagreement.Generally,theRegistered
NeighborhoodAssociation(RNOwhichisBRUN)isasignatory,alongwiththebusiness(GLEAM)
andindividualneighborsasappropriate.

1. CharbonneaumetwithtrafficengineersHerseyandSchmitz,whoassuredhimthattheywill
evaluateandaddressanyappropriatetrafficandpedestrianchangestothelightat38thand
Wolffasrequested.
2. Charbonneaudiscussedqueuingonpublicstreets,specificallywithHerseyandSchmitz.Itisnot
illegaltobrieflyqueueonapublicstreet.However,ifqueuingcreatesasafetyissue,thetraffic
departmentwillworkwiththebusinessownerstoresolvetheproblemsotheconcernover
safetyisaddressed.
3. ThetrafficengineerssuggestedthatsignageatthebusinessegressforbothWolffandXavier

EmployeeParking
1. Gleamwillrequiretheiremployeestoparkonavenues,notstreets,asavenuesgoeastandwest
andtypicallydonothavehousesordrivewaysfacingthem.
2. Gleamwillnothavemorethanfourorfiveemployeesperblock.
3. AdherencetotheparkingregimewillbeaconditionofemploymentforGleamemployeesandis
fullyenforceablewithinGleamsprogressivedisciplinepolicy.
4. Gleamwilllookintosometypeofidentifierfortheemployeecarsoneighborswillknowthecar
isassociatedwiththecarwashandnotbeconcernedaboutstrangerspresenceinthe
neighborhood.
5. However,atthistimeGleamwillnotbeactivelymonitoringwhereemployeesparkandwillask
theneighborstoinformthemofanyabuses.
6. Gleamalsoplanstomakebuspassesavailablefortheiremployees.

QueuingonNormalDays
1. CarsexitingthecarwashoptionwillexitontoWolffandbeallowedtoturnleftorright.
2. CarsexitingthedetailingoptionwillexitontoXavierandwillbesignedasleftturnonly,keeping
trafficoutoftheneighborhood.

QueuingonBusyDays(definedaswhenthereareonly12emptyqueuingspotsontheGleamlot).
GleamexplainedthattheywillopttoqueuecarsupWest38thandnotonWolff.Terrysbusiness
isatthecornerofWolffand38th,withtheentranceonwest38th.Terryexpressedconcern
aboutcarsblockinghisentranceandweagreedthatfurtherdiscussionneededtotakeplaceina
searchforanalternativesolution.
1. EnteringandexitingthecarwashonWolff
a. EnteringbycomingsouthonWolffwillbediscouragedbytemporarysignage.This
shouldeliminatethequeuingalongWolffnorthofthecarwash.Theprimaryand
encouragedentrancewillbefrom38th.
b. Temporarysignage(noleftturnintotheneighborhood)willbeplacedatthecarwash
exitallowingrightturnsonlyontoWolffandoutonto38th.
c. Ifsignagedoesnotcontrolthequeuing,anemployeeoroffdutypoliceofficerwillbe
used.(Therewasdiscussionaboutthelogisticsofhiringanoffdutyofficer,whichwell
followuponlater.)
d. Wealsodiscussedtheuseofsemipermanentconestohelpmanagetraffic.
2. ExitingontoXavier.Onbusydaysleftorrightturnswillbeallowed.Thiswillmovetraffic
quickerandavoidqueuing.
