On August 23, 2015, the complainant found out upon arriving home that his cash

money worth Twenty Two Thousand Pesos (P22,000.00) and assorted jewelries were
missing. Then after the complainant blottered the incident at the office of the
Barangay of Brgy. San Miguel, Digos City, he saw the respondent going to Purok
Caymeto but he evaded and run when asked by the complainant to see his back
pack. That on the same day the respondent was spotted at Gaisano Grand mall of
digos carrying the same back pack and on the occasion thereof. Such that a
necklace and a 357 revolver loaded with Six (6) live ammo was found therein on the
said back pack.
