OnWednesday,March16th2016,theSupremeCourtJusticesonceagain
weighedtheiropinionsbetweentheTheologicalandreligiousandtheConstitution.The
eightjusticeswerefacedwiththeargumentofmandatingthatbusinessesprovidebirth
controltowomenundertheAffordableHealthcareAct.TheCourthadpreviouslyheard
asimilarcasebackin2014,

.Atthetime,thelateJustice
AntoninScaliawasinthemajorityandinthispresentsituation,manyhopethatthevote
nowswingsintheirfavor.
TheargumentagainstthemandatestemsfromtheReligiousFreedomActof
1993whichstatesthatagencies,departments,orofficialsoftheUnitedStatesorany
stateareprohibitedfromsubstantiallyburdeningapersonsexerciseofreligion.Many
religiousorganizationsarefightingfortheirrighttofreedomincludingTheLittleSisters
ofthePoorwhichfacilitatesnursinghomes.TheLittleSistersofthePoorsaythatthe
mandatethatwouldrequirebusinessestoprovidewomenwithbirthcontrolis
unconstitutionalbecauseitinfringesontheirreligiouslibertiesthereligiousorganization
objectstoplayingaroleinanyformofthedistributionofcontraceptivestowomen.
Someorganizations,however,areonlyobjectingtointrauterinecontraceptivesandthe
morningafterpill.Earlyonintheargument,JusticeSoniaSotamayoraskedhowthis
casediffersfromtheprosecutionofconscientiousobjectorstowarandtheir
unwillingnesstoregisterwiththegovernment.AdefenderfortheLittleSistersofthe
Poor,Mr.PaulD.Clement,arguedthat
Myclientswouldlovetobeaconscientious
objector,butthegovernmentinsiststhattheybeaconscientiouscollaborator,hesaid.
Thereisnosuchthing.

Thedefendersofthemandateremainfirmintheirideologythatthisactdoesnot
andwillnotinfringeontheReligiousFreedomActof1993.Muchofthedisagreement
surroundingtheirargumentwaswhetherornottherecouldbebirthcontrolprovidedfor
womenwithoutusingthegroupsinsuranceplans.JusticeSamuelAlitosuggestedthat
thegovernmentusetheinsuranceexchangescreatedundertheAffordableHealthcare
Act.JusticeAlitostatedthatintheideahepresentedtheeffectonwomenwouldbe
minimal.JusticeSotomayor,however,statedthatthereshouldbeminimalhardshipsin
providingcontraceptives.Whencontraceptivesareprovidedtowomeninaseamless
way,shesaid,thenumberofunintendedpregnanciesdramaticallyfalls,asdoesthe
numberofabortions.Religiousgroupshavebeenobjectingtoallalternativesthatthe
courthaspresentedtothem,includingtheabilitytooptoutuponcompletionofaform.
Thecourtremainsverydivided,themoreLiberaljudgesallappearedtobefor
thealternativesolutionasopposedtothemandate.TheConservativejudgesseemed
mildlyagainstthesolutionandweresolidlyagainstthemandate.TheLiberaljudges
mustattracttheswingvoteofAnthonyKennedyinordertosucceed.Atiewouldresult
inthestandingofthelowercourtdecisionwhichwouldnotaffectthecountryasa
whole.
