FormyproductIcreatedascenariocourtcasefile,whichshowsthenegligenceand
abuseingrouphomesofchildrenandthosewithdevelopmentaldisabilities.Thisgenreiswould
beseeninacourtroomorattorneysmeeting,whiletheaudiencewouldbethejudgeandjury.
ThereasonIchosetheparticulargenrewasbecauseIthoughtitwouldbeagoodwaytoreally
showwhatisreallyhappeningbehindcloseddoorsoftheseinstitutions.
AlthoughIamusingafewofmyprevioussources,Ialsofoundsomenewscholarly
articlesthatwouldhelpmelearnmoreaboutthelegalaspectsofthisissue.Thesesourceswill
helpguidetheprocessofcreatingmyproductandwillalsohelpitcomealive.
SomethingsthatIhavelearnedfromthearticlesIfoundisthatsomestatesusetheir
grouphomeinstitutionsasawaytogetfederalfunding,andnotreallyuseittobenefittheir

wherethestatewarehousesthemformillionsofdollarsayearattaxpayerexpense(Sausser).
Allofthesethingsarehappeningandnooneissayinganything,ornoonewantstheirbusinesses
reputationtoupholdallegationslikethese.

EithertheviolationwasnotpreviouslyidentifiedbytheDepartmentoritsauthorized
representativeortheviolationwasdiscoveredbythefacilityandwasselfreported,
butineithercasetheviolationhasbeencorrected.

Aviolationbyafacilityisdetrimentaltothehealth,safety,orwelfareofanyresident,
butwhichdoesnotresultinsubstantialriskthatdeathorseriousphysicalharm,
abuse,neglect,orexploitationwilloccur.
RepeatedViolations
TheDepartmentshallimposeacivilpenaltywhichistrebletheamountassessedunder
subsection(a)ofG.S.131D24whenafacilityunderthesamemanagement
orownershiphasreceivedacitationduringtheprevious12monthsforwhichthe
appealrightsareexhaustedandpenaltypaymentisexpectedorhasoccurred,and
thecurrentviolationisforthesamespecificprovisionofastatuteorregulationforwhich
isreceivedaviolationduringtheprevious12months.

Thesearetheregulations,howeverpeoplearestillabusingandmistreatingresidentswith
disabilitiesandnothingitbeingsaid.Thereforenoonereallyhearsaboutthelegalaspectsof
caseslikethese.
ThisiswhereIhopethatmycasefileproductrepresentsthelegalprocessofthese
incidents.Itriedtopointoutredflagsthattheyemployershouldhavenoticed.Ialsopointed
outtheincidentreportsandemployeewriteup,showingthecaregiversnegligence.Thiswill
showhowmistreatmentthatisnotreallymentionedcanreallyhappen,andwhatcanhappen.
