Hughes, is a member of the Division of Criminal Justice assigned the Blder Services Bureau in the Office of the Chief State’s Attomey, having more than 28 years experience in the field aw enforcement and criminal investigations. That the affiant Hughes has investigated numerous crimes which have led ‘arrest and conviction of persons in the State of Connecticut. That the affiant has personal knowledge of the facts and ‘ire sastances hereinafter related as a result of his own investigative efforts, and/or efforts from other Federal, State and/or Mur iefpal agencies, private and public corporations, entities and private citizens. This affidavit doesnot purport to set forth at ¢ the relevant information leamied during the course of the investigation. Rather, the affiant Hughes has set forth only ‘hose facts that are believed necessary to support the charges cited 2t the end of this affidavit 2) in September 2009, the affiant Hughes received information from the Branford Police Department regarding Aes nents, 42 Kimberly Ave, New Haven, The information received was provided to the Branford Police Ser ariment Detective Bureau, by a cooperating witness, or CW, who stated the owner of Ace Amusements, George "ty, is presently and on a continuous basis buying stolen merchandise. One day the CW ran into Connelly who stated 228 looking for ‘new in box” power tools. The Branford Police Department stated that Connelly was placing “an order” 1s the CW, knowing the CW has a history of committing burglaries and larcenies. 3) _~_ That in September 2009, the affiant Hughes spoke with and interviewed the CW. The CW informed the affiant “'sgacs that the CW has been in and out of trouble for years. The CW has a criminal record in the State of Connecticut for iarvtary and Larceny, The CW stated anytime CW committed a larceny, the stolen items could be sold at Ace “ssements, New Haven, in exchange for cash. The rate that Connelly would pay for any ‘ndise that would be brought in, “new in box” or otherwise, would usually be about one third of the retail . epot and Target Corporation. Intelligence supplied by them indicated that Pawn Shops in Connecticut ‘wets presently and on a continuous basis buying power tools and reselling the merchandise at a price that is ‘low the retailers cost when purchasing the item directly from the manufacture. 5) That on April 15, 2009, and May 5, 2009, a undercover officer went to Ace Amusements, 42 Kimberley ‘Ave,, New Haven with a power too! and presented it in such a manner to indicate it was probably stolen cn each -casion. The undercover officer completed the transaction with “Paul” and in exchange for giving the power 1 to hit, the officer received cash. The undercover officer arraigned with “Paul” to deliver e “pallet” of DeWalt power tools to Ace Amusements during the second transaction. On June 3, 2009, the undercover ufficer delivered a “pallet” of “new in box” power tools supplied by Home Depot security representatives to use 7.0 criminal investigation, with the retail value of $11,693.00, that was represented as stolen, in exchange for sgrei-mnq $3,700.00 in cash. On June 3, 2009, Task Force officers executed a Superior Court search and seizure ‘ae 0 at Ace Amusements and in addition to seizing evidence, made two arrests. ') That based on the new information provided by the Branford Police Department, and the CW, the “Ofiice of the Chief State's Attorney initiated a criminal investigation utilizing the Connecticut State Police, ‘“ve-dwide Organized Crime Investigative Task Force, or SOCITF. 8 stat on October 8, 2009, the CW was sent to Ace Amusements, 42 Kimberly Ave., New Haven, Connecticut, with “new in box” merchandise consisting of a BlueRay “Ultimate Matrix” 6 pak, DVD collection, and two X-Men Origins, Wolverine DVD’s, and fourteen (14) packages of Gillette Fusion Power Razors. The “WD's were supplied by Target Scourity representatives and were affixed with security sensors by Target and 42 normally removed before the items leave the store. The security sensors activate an alarm upon exiting from iarget. The Gillette Razors were supplied by the Branford Police Department who obtained them from ‘Walgreens Corporation to use in an criminal investigation, The total suggested retail value of the DVD's and razors equaled $303.79 The Gillette Razors did not contain price stickers on the packaging. ‘The merchandise -vas presented in such an manner to indicate it was stolen or probably stolen. ‘That the CW was equipped with an electronic recording device that wes secretly located on CW's perict > scarch of the CW was made with no monies be found on CW’s person. The CW stated that Connelly and Paul were the two men identified in Pasiographs marked one and two that were shown to the CW in September 2009. 1) Thaton October 16, 2009, an undercover officer, Detective Dennis Sang assigned to SOCITF, went Ace Amusements, 42 Kimberly Ave., New Haven, with the CW. They were provided with “new in box” rwachandise, The merchandise consisted of a BlueRay “Ultimate Matrix” 6 pak, DVD collection, one X-Men Crigins, Wolverine DVD, and 23 Gillette Fusion Cartridges 4 ct. Also, Branford Police Department supplied 10 cartons of Newport 100's cigarettes that did not contain a tax stamp. The DVD's were supplied by Target Security representatives and were affixed with sccurity sensors by Target, The security sensors activate an Marin upon exiting from Target. The CW called the undercover into Ace's and introduced ‘hit 40 Paul, The UC presented the untaxed cigarettes to Paul, The UC and CW exit Ace’s and meet with participating officers. CW handed the affiant Hughes $294.00 in US Currency that was received from Paul in ‘change for the DVD's, cartridges, and cigarettes. The CW was again searched with no monies being found, ‘That on October 20, 2009, Detective Dennis Sang acting in an undercover capacity, and the CW went ~ amusements, New Haven. They were provided with “new in box” merchandise. Both the officer and CW met with participating officers. ike CW handed the affiant Hughes $127.00 in US Currency that was received from Panl in exchange for the bette cartridges and cigarettes. The CW was again searched with no monies being found on CW's person. 25). .. That on October 28, 2009, Detective Dennis Sang, acting in an undercover capacity, and the CW went 49 Ace Amusements, New Haven. They were provided with “new in box” merchandise. The merchandise consisted of (11) packages of Gillette Fusion cartridges 4 ct. Also, a DeWalt, 6 Tool Combo Kit, Model '2CK655X. The total suggested retail value of the cartridges and DeWalt Combo Kit equaled $759.39. The street and discard the bag into a city garbage can on the sidewalk. Paul reportedly returned to, and entered ‘cz Amusements. Det. Tobin immediately retrieved the garbage bag and later examined its contents. Dennis Sang went to ‘Ace Amusements, 42 Kimberly Ave., New Haven in an effort to further negotiate with George Connelly the sabing of merchandise atthe storage facility represented to be stolen. The officer utilized an audio recording Sesive. Upon the officer entering Ace Amusements, the officer engaged in a conversation with George. The futlowing conversation took place; Officer: Hey George, did Paul talk to you, I gave him a list. George: don’t work on Sunday's, you gave him a list of what? Officer: The stuff, he said he wanted paperwork. The officer was observed to enter Ace Amusements at 0958 hours with the merchandise supplied to ram, Shortly theteafter the officer was observed exiting empty handed. The officer met participating officers at ' arearranged location. The officer handed the affiant Hughes $170.00 in US Currency that the officer stated he se ived in exchange for the Bosch power tool. 3) The undercover officer stated the following. Upon entering Ace Amusements he spoke with George end Paul. The officer told them that he went “shopping” and picked up a couple of TV's and a couple of Garmins. The officer stated he told both George and Paul if they want his ID (identification) he would provide ic, adding he told them if anything ever happens don't hold me ont there, The officer informed George and Pau! tuat he has two 32 inch TV's and asked if they wanted them, George replied, “Yeeh.” The officer informed Ceorge that he had credit cards and wanted to know ifhe wanted to buy them. George stated he did not, ‘George said let everybody else buy the stuff and he would go from there. The officer informed George that it 28 cagy, you just go buy stuff, you just have to be careful. George stated he docsn’t want to now anything, he can't want to hear anything, George continued, “Just come in, bring me something and we'll go from there, ‘cot less said the better.” The officer stated he told George, “Alright.” W The officer continued by stating when he was speaking with George, Paul looked up the retail price of Bosch power tool and told him he would provide $170.00 for it. The officer stated he spoke further with George and Paul about the items in the storage facility snd George informed him that he is busy and he wanted the officer to bring in the items that he could fit into his sehicle. The officer said George would take whatever he brings i. 2) That on December 18, 2009, acting in an undercover capacity, Det. Dennis Sang met participating ‘¢‘ficers at a prearranged location. The purpose was to provide the undercover officer with “new in box" merchandise to present to Ace Amusoments, 42 Kimberly Ave., New Haven, The merchandise consisted of a “TETIPower Saw, WSR 900PE, and a COBRA Ramset Neumatic Fastener with identifying number :2$20069419 on the box. Also, five BlueRay DVD movies, two, “The: Godfather,” one, “Walk Hard,”and two ‘The Devil Rejects.” The total retail cost for the power tools and DVD's equal $854.95. ‘The two “The Le-vilis Rejects,” and “Walk Hard” DVD's were enclosed in a security locking device. The DVD's are obtained 15 using a specific device to unlock the outer case supplied by a retail establishment. The security device is vrai to deter theft, as the DVD's locked in these cases cannot be easily retrieved without the use of @ special ry. While under constant surveillance the undercover officer went to Ace tmusements with the power tools and DVD’s. At 1115 hours the undercover officer entered Ace Amusements "the merchandise in an effort to speak with George Comnelly. Upon entering Ace Amusements, the officer od Paul and George if they were mad at him, The officer stated that George responded, Are you retarded? You said you were going to come back and * you never came. Let me ask you a question? You got stuf tike that, you could of put it in your car. Iunderstand you can’t put a refrigerator in your car, or whatever you said, you couldn't put a generator in your car, but you could of put the little stuff in % your car. The officer stated he showed George the DVD's that were vated in a security device and informed him that he had to remove the enclosed DVD from the secured case before he sells them. George agreed to pay the officer $5.00 for each DVD, saying they were old movies, and he would probably get $10.00 for them, Shortly thereafter, the officer was observed exiting Ace Amusements smuty handed. The officer was under constant surveillance and met participating officers at a prearranged Iovation, The officer handed the affiant Hughes $175.00 in US Currency that the officer stated he received from Taal in exchange for the power tools and DVD's. That on January 13, 2010, acting in an undercover capacity, Det. Dennis Sang met participating ficers at a prearranged location, ‘The purpose was to provide the undercover officer with “new in box” shandise to present to Ace Amusements, 42 Kimberly Ave., New Haven. The merchandise consisted of a tilips 32", LCD/HD television, serial number DS140935274006, retail $419.00, supplied by Target security #*connel to use in a criminal investigation, 47} __ That the television box contained an anti-theft security device known as Spider Wrap. Spider Wrap is 4 security sensor attached to a hard item via locking cables that wrap around the item in at Jeast two directions, ‘Th: specific model of Spider Wrap used in this undercover operation emits a loud noise if the cable is cut. Also, the alarm is triggered upon exiting a Target store if the Spider Wrap is not removed at the time of ¢ wthase, Itis standard practice for Spider Wrap and other similar security devices to be removed from 2 loans with the items as collateral. In fact, all transactions were completed with the payment of US -xyeney, commonly referred to as “cash.” 23) That the affiant Hughes knows from his experience involving pawn shop and swap shop investigations twat their owners will routinely conduct video surveillance of transactions, as well as the entrances, exits, and ‘ter areas of business. ‘The video records of such surveillance are often archived either in videotape format or “in electronic digital form and stored either on computer hard drives, external hard drives, removable disks, flash type media or other electronic storage devices. £9) That during the course of this investigation, the CW and undercover officer utilized telephone facility 7€3-494-7807 to make contact with George. George utilizes this telephone in the continuance of his illicit creninal activities, On February 18, 2010, at approximately 1135 hours, the undercover officer dialed 203- 14-7807, telling him he had another television for him. George informed the officer to bring the television to Acs Amusements. The officer proceeded to Ace Ariusements and presented George and Paul with a television cataining spider wrap. The two oc rants are “Specialist80," and “pck-sales.” The “Specialist 80” account has over 20,838 listed feedbacks, Hath accounts reveal the seller has sold an extensive amount of “new in box” merchandise. Feedbacks are a «ating system offered by eBay to buyers, rating their experience with the seller. ei, That the affiant Hughes condueted a check with eBay Fraud Analyst Matthew Flinders regarding azrount holder information for 'Specialist80" and “pck-sales,” This check revealed that “Specialist80" is istered to Lance Williams, Norwalk, Connecticut, and “pck-sales” is registered to Paul] Muzyka of North Haven, Connecticut. Both accounts were opened in 2003. Since 2003, Paul Muzyka has received approximately $100,000.00 from seles and Lance Williams has received approximately $2,500,000.00 (two ‘thon five hundred thousand dollars) from sales, Mr, Flinders etated that the PayPal payment information for ‘sota Muzyka and Williams reveals the same account has been used as a means for accepting monies for + ecchandise sold. 42) __ That additionally, based on the training and experience of the affiant Hughes, person/s involved in sbimitting larceny will often establish a scheme that would mislead, misrepresent, and/or deceive others as to sir method of operation. Often person/s engaged in this activity will create documents and/or paper trails that +.¢ not authentic. This creates the appearance of legitimacy, when in reality those documents are fraudulent “his purpose of these efforts are to avoid law enforcement detection. ‘The affiant Hughes believes that George ‘ vaielly and Paul Muzyka, on a present and continuous basis, utilize Ace Amusements as a means of wiitating illegal criminal activities, by creating the appearance of legitimacy with their “Brokers License.” Ebis has been accomplished by taking in mezchandise that has been presented in such a manner to indicate itis valen, or probably stolen.
