Dear Mr. Blutstein:
In accordance with the provisions of the Freedom of Information Law (FOIL), New York State Public
Officers Law, 84 et seq., the New York City Department of Parks & Recreation (Parks) hereby denies
your above-referenced FOIL request.
Please be advised that 87(2)(g) specifically allows an agency to deny access to records or portions thereof
that are inter-agency or intra-agency materials which are not: i. statistical or factual tabulations or data;
ii. instructions to staff that affect the public; iii. final agency policy or determinations; or iv. external audits,
including but not limited to audits performed by the comptroller and the federal government. The e-mail
communications you seek contain deliberative, non-final intra-agency and inter-agency communications
between Parks and the Office of the Mayor, discussing the event, that do not fall within one of the above
exceptions to the 87(2)(g) exemption.
Under 89(4)(a) of the FOIL Law, you have the right to appeal this denial within thirty (30) days to the
Commissioners designee, General Counsel Alessandro G. Olivieri, who must affirm and explain the denial
or reverse this decision within ten (10) business days of the receipt of your appeal.
