Facts: Michael Pennisi an Australian citizen who played for the Philippine Basketball Association team Barako bulls filed
a recognition as Filipino citizen before the Bureau of Immigration. Petition for Commisioner Yap granted the recognition
of Pennisi as a Filipino citizen on the ground that his mother was a Filipino citizen staying in Australia. The Board of
games and amusement passed a resolution deporting PBA players who are not Filipino citizens. Pennisi then contested.
Issue: Whether Pennisi should be deported.
Held: No, upon the courts review, we believe that there is substantial evidence supporting the claim of citizenship, so
substantial that there are reasonable grounds for the belief that the claim is correct. When the evidence submitted by a
deportee is conclusive of his citizenship.
