Stipulated Facts:

Ashley Williams and Michael Davis are both seniors at New Columbia University majoring in

business
Ashley and Michael had met in their freshman year in October of 2005 after meeting through

shared classes and began dating until May of 2006

After a 15 month separation the two began dating again in September of 2007
On the night of December 6, 2007, the couple attended an off campus party where they

consumed alcohol together.

The rape in question took place in the early morning of December 7, 2007, after returning from

the party to their apartment alone

On December 8 Ashley visited a rape counselor at the universitys health clinic and she filed a

formal complaint with the police on December 10

Detective Jessie Young obtained a search warrant for Davis apartment on December 11 and
found a torn shirt matching the description of the one Williams wore that night, as well as many

of her other belongings

shortly after Michael Davis was arrested and charged with the rape of Ashley Williams

Hurt by separation and blames Davis for causing it and resents for him for moving on so quickly
Cared for Davis but wanted emotional independence and cut off contact.
Tried to slowly grow a healthy relationship after having classes together, despite strong feelings
Tried to keep sex free, but had sex once on birthday and regretted it.
Claims that it became progressively more difficult to get Davis to stop
Shows signs of jealousy towards Davis relationship with Jenny Jackson
Both had alcohol at party but not drunk
Claims that after returning from party Davis made progressive sexual advances that she turned

down u until he forced her to have sex with him

Noticed a note from Jenny jackson on his desk and left after distraught
Was advised to see a rape counselor by her roommate.

worked at university for 5 years, 2 as general counselor, 3 as a specialist for rape and sexual

assault victims
Met Ashley Williams December 8 after she came into his office
Claims Williams showed wide variety of emotions when asked about nights events
Also claims that Williams showed typical behavior of someone experiencing Rape Trauma

Syndrome
Advised her to file claim with police.
