Unit 1: The Law of Negligence (LGST 3040)

Rationale

Students Explore the legal meaning of negligence and legal actions relating to negligence.
Overview
This unit focuses on Private law and the function of the court system and how it functions
(or fails) to restore and maintain civil justice. Students will begin the unit by exploring the
court system and civil law, and examine the diferent types of private law, focusing mainly
on tort law. Students will learn that tort law is the type of private law that deals with
wrongs, other than breach of contract, that one person commits against another.
Negligence is a major cause of action in tort law and will be examined in depth through
exploration of the terms duty of care, standard of care, causation, liability, foreseeability
and loss. These terms will form the basis of understanding for the law of negligence.
Students will take an in depth look at the case of Donaghue vs. Stevenson (or the Paisley
snail case) as this was a foundational decision which established the modern concept of
negligence by setting out the principles by which one person (or company) would owe
duty of care to another person (or consumer). Students will also watch the film Hot
Cofee which documents the case of Liebeck vs. McDonalds (or the McDonalds cofee
case). This film study explores how this case and other frivolous law suits like it can
weaken civil justice. Following this case study the class will explore special types of
liability, among negligence/liability suits; special types of liability/negligence are the most
common. Special types of liability include professional liability, occupiers liability, motor
vehicle liability and strict liability. Additionally students will learn about the diferent
defences for suits of negligence such as contributory negligence, voluntary assumption of
risk, and inevitable accidents. To finish of the unit, students will prepare, present ad
reflect on a mock trial which will allow them to showcase all they have learned throughout
the module as well as communication, information management, and problem solving
skills.

Rationale
The study of Negligence will help students to prevent themselves from committing
negligent acts in their own lives. Studying important cases of liability/ negligence will help
students firstly to see how and why the modern concept of negligence was developed and
secondly, to see that the law of negligence does not always function, as youd think it
might. To some students it may seem that negligence suits happen only rarely and only on
TV or in the movies, but this unit will have them realise that negligence suits can result
without malicious intent to pretty much anyone. It is useful for students to understand that
in almost all parts of their private and public lives, they owe a duty of care to those around
them. Duty of care, standard of care and liability are very important terms that all
members of society should understand in order to maintain the safety and well being of
themselves and the people that they come into contact with each day.
