REPORT OF THE JOINT COMMITTEE ON THE CANVASS OF VOTES FOR THE PRESIDENTIAL AND VICE PRESIDENTIAL CANDIDATES IN THE MAY 9, 2016 ELECTIONS 1 CONSTITUTIONAL MANDATE The 1987 Constitution mandates the Congress of the Republic of the Philippines, in Joint Public Session, to canvass the votes for President and Vice President and to proclaim the duly elected candidates who obtained the highest number of votes. Section 4, Article VII of the Constitution provides that The rotums of every election for President and Vice- President, duly certified by the board of canvassers of each province or city, shall be transmitted (o the Congress, directed to the President of the Senate. Upon receipt of the certificates of canvass, the President of the Senate shall, not later than thirty days after the day of the election, open all certificates in the presence of the Senate and the House of Representatives in joint public session, and the Congress, upon determination of the authenticity and due execution thereof in the manner provided by law, canvass the votes The person having the highest number of votes shall be proclaimed elected, but in case two or more shall have an equal and highest number of votes, one of them shall forthwith be chosen by the vote of a majority of all the Members of both Houses of the Congress, voting separately. The Congress shell promulgate its rules for the canvassing of the certificates. ll, RULES OF THE JOINT PUBLIC SESSION On 24 May 2016, the Senate and the House of Representatives, in Joint Public Session, adopted the Rules of the Joint Public Session of Congress for Canvassing the Votes for the Presidential and Vice Presidential Candidates in the May 9, 2016 Elections (Annex “A” — Rules of the Joint Public Session of Congress for Canvassing the Votes for the Presidential and Vice Presidential Candidates in the May 9, 2016 Elections.) STN Pursuant to the Rules of the Joint Public Session, the Senate President and the Speaker of the House of Representatives appointed seven (7) members from each House to constitute the Joint Committee. Four (4) alternate members from each House were also appointed to perform the functions of the regular members of the Joint Committee in case of the absence or unavailability of the said members. Ronaldo B. Zamora t. CERTIFICATES OF CANVASS. All the Certificates of Canvass (COCs) were opened by the Senate President in the presence of the Senate and the House of Representatives in Joint Public Session The Joint Committee canvassed a total of one hundred sixty-seven (167) COCs. One hundred twenty-three (123) COCs were electronically transmitted to the Consolidation and Canvassing System (CCS) from the Board of Canvassers of provinces, cities, districts and overseas absentee voting countries. [ANNEX “B” — List of COCs Electronically Transmitted to the Consolidation and Canvassing System (CCS) In Order of Arrival] while forty-two (42) COCs were physically delivered to the Senate of the Philippines from the Special Board of Canvassers for overseas absentee voting, local absentee voting, and detainee voting. (ANNEX “C” - List of COCs Physically Delivered to the Senate of the Philippines.) The COC for Taiwan was included.in the special electoral diplomatic pouch from the People's Republic of China while the COC for Russia was delivered to the House of Representatives after the Joint Committee had already convened Pursuant to the Rules, the COCs were canvassed in the order that they were received IV. JOINT COMMITTEE PROCEEDINGS The Joint Committee convened on 25 May 2016 and held three (3) meetings. The Joint Committee required the presence of COMELEC to assist the Committee in its mandate to determine the authenticity and due execution of the COCs. Counsels of the candidates were present throughout the proceedings and were afforded the opportunity to examine all the COCs, and to arficulate, verbally or in writing, their objections and manifestations A. DAY 4 - 25 MAY 2016 On the first day of the Joint Committee Meeting, a total of forty-eight (48) COCs were considered for canvass. Forty-five (45) COCs were canvassed while the consideration of three (3) COCs was suspended (Laguna, llocos Sur, and Davao del Norte) due to the erroneous transmission of Pre-Logic and Accuracy Test (Pre-LAT) results, The Provincial Board of Canvassers (PBOC) of the three (3) provinces were ordered to personally appear and explain before the Joint Committee. (ANNEX “D" - ‘Subpoena Ad Testificandum addressed to the Chairperson, PBOC, Laguna, ANNEX “E” - Subpoena Ad Testificandum addressed {0 the Chairperson, PBOC, Ilocos Sur, ANNEX “F” - Subpoena Ad Testificandum addressed fo the Chairperson, PBOC, Davao del Norte) The COCs from the Province of Davao del Sur, and the COCs from the Kingdom of Bahrain and Malaysia were canvassed despite the multiple electronic transmission of COCs thru the CCS, in the case of Davao Del Sur; and the lack of physically delivered COCs to Congress, in the case of Bahrain and Malaysia. When the COC for Davao del Sur was considered, the Joint Committee observed that there were multiple electronic transmissions, one of which included the Pre-LAT results. The Joint Committee canvassed the COC for Davao del Sur after having confirmed that the physically delivered COC matches the electronically transmitted COC. Nevertheless, the Joint Committee ordered the COMELEC, through Commissioner Christian Robert S. Lim, to submit within twenty-four (24) hours a written explanation thereon. (Annex “G” - Order of the Joint Committee; Annex “H” Letter dated 26 May 2016 of Atty. Jose M. Tolentino, Executive Director, COMELEC) Similarly, when their respective COCs were considered, the Senate Reception and Custody Group reported to the Joint Commitee the absence of the physically delivered COCs from Malaysia and Kingdom of Bahrain. Since no objections were raised against the inclusion of their electronically transmitted COCs, the same were canvassed. The Joint Committee also ordered Commissioner Lim to submit within twenty-four (24) hours a written explanation thereon. (Annex “I” - Order issued by the Joint Committee for Malaysia; Annex “J” - Order issued by the Joint Committee for Kingdom of Bahrain; Annex “K’= Written Explanation by Atty. Maria Juana Valeza, Office for Overseas Voting, COMELEC) B. DAY 2-26 MAY 2016 A total of seventy-three (73) COCs were considered for canvass, Sixty-nine (69) COCs were canvassed, including the COCs for Laguna, Ilocos Sur, and Davao del Norte, after the concemed PBOC Chairpersons personally appeared and satisfactorily explained before the Joint Committee the discrepancies in the electronically transmitted COGs from the physically delivered COCs. The consideration of the four (4) COCs from Antique, State of Kuwait, lloilo City and Canada were suspended. The reasons for the suspension and the corresponding actions taken by the Joint Committee were as follows 4) Antique — The Joint Committee ordered the PBOC for Antique to appear and explain, within twenty fours (24) hours, the discrepancy between the electronically transmitted COC and the manually counted and physically delivered COC (Annex “L’ 2) State of Kuwait — The Joint Committee required the COMELEC to submit a Written Explanation for the absence of the special diplomatic electoral pouch containing the COC (Annex “M”), 3) lloilo City — The Joint Committee required the CBOC of lloilo City to personally deliver the manually counted COC which could not be found inside the ballot box (Annex “N"); and 4) Canada — The Joint Committee required the COMELEC to submit a Written Explanation for the absence of the special diplomatic electoral pouch containing the COC (Annex “O”). The written explanation for the absence of the physically delivered COCs for the State of Kuwait and Canada was submitted by Director Maria Juana Valeza, Office for Overseas Voting, COMELEC (Annex “P”). When the special electoral diplomatic pouch from the People's Republic of China was opened, it was manifested that it contained both the printed copy of the electronically transmitted COC for China, as well as the manually counted and physically delivered COC for Taiwan. Finding both authentic and duly executed, the Joint Committee separately canvassed the COCs for China and Taiwan The Joint Committee, having been informed by the COMELEC of the discrepancies in the electronically transmitted COCs from Lanao del Sur and Northem ‘Samar, issued subpoena ad testificandum to the Chairpersons of the PBOC of these provinces, to appear before the Joint Committee on May 27, 2016 and explain the discrepancies (Annex “Q"- Subpoana to the PBOC of Lanao del Sur; and Annex “R” Subpoena to PBOC of Northem Samar). C. DAY 3-27 MAY 2016 A total of fifty-three (53) COCs were considered for canvass. The COCs for Antique, lloilo City, Kuwait and Canada, the consideration of which was suspended the previous day, were canvassed after the Joint Committee found the explanation of the PBOC, CBOC and the Director for Office of Overseas Voting, COMELEC satisfactory. V. RESULTS OF THE CANVASS The results of the canvass show that RODRIGO ROA DUTERTE and MARIA. LEONOR GERONA-ROBREDO obtained the highest number of votes among the candidates for President and Vice President, respectively. RECOMMENDATION IN VIEW OF THE FOREGOING, the Joint Committee recommends that Congress, in Joint Public Session and acting as the National Board of Canvassers, approve and adopt the Report of the Joint Committee and the Resolution of Both Houses No. 1 entitled, “Resolution Approving the Report of the Joint Committee Declaring the Results of the National Elections held on May 9, 2016 for the Office of the President and Vice-President and proclaiming RODRIGO ROA DUTERTE and MARIA LEONOR GERONA-ROBREDO as the duly elected President and Vice- President of the Republic of the Philippines” Approved, JOINT COMMITTEE HOUSE PANEL 4 Neptali M{Gonzales Il Chaitgerson ae Elpidio F. WHEREAS, pursuant to Article VII, Section 4 of the Constitution, Republic Act No. 7166, Republic Act No. 9369 and the Rules of the Joint Public Session of Congress for the Canvassing of the Votes for the Presidential and Vice Presidential Candidates, the Joint Committee of both Houses canvassed the Certificates of Canvass sent to Congress duly certified by the Board of Canvassers of each province, city and district and for absentee voting (local and overseas), and publicly counted the votes of the candidates for the Offices of the President and Vice President in the national elections held on May 9, 2016; WHEREAS, the Joint Committee, after determining the authenticity and due execution of the Certificates of Canvass in the manner provided by law, canvassed the votes; WHEREAS, the Joint Committee found the results of the canvass, as follows: For the Office of the President: 1. ROBREDO received the highest number of votes cast for President and Vice President, respectively, in the national elections held on May 9, 2016 and by virtue thereof, to proclaim RODRIGO R, DUTERTE as the duly elected President of the Republic of the Philippines and MARIA LEONOR G.
