Abstract
This article comprise of opinions of scholars about definition
of AlISTHSAN and its meaning, kinds, and status. According to
jurisprudents, Al-ISTHSAN is the fifth source of Shari AHKAAM.
Imam Hulwani Hanfi defines ISTHSAN as follows:- (Turk al Qeyas Al
Jli le dlil min kitab ow sunnah ow ijmah). According to Hanfi, Malki
and Humbali jurisprudents, ISHTSAN is the source of Shariah and it
gives testimony about Shari-AHKAAM. They proved their opinions
with the help of various arguments in the light of Quran and Sunnah.
Imam Shafi and Imam Ibn-e-Hazam Al Zaheri are among those
scholars who deny Al- ISHTSAN as source of Shariah. They have also
tried to prove their opinions. In this article both of the point of views
have been discussed, Moreover, with the help of different examples
this topic has been explained.
