Section1300.430PrescriptiveAuthority

a)Acollaboratingphysicianorpodiatricphysicianwhodelegatesprescriptiveauthoritytoan
advancedpracticenurseshallincludethatdelegationinthewrittencollaborativeagreement.This
authoritymayincludeprescriptionof,selectionof,ordersfor,administrationof,storageof,
acceptanceofsamplesof,anddispensingoverthecountermedications,legenddrugs,medical
gases,andcontrolledsubstancescategorizedasanyScheduleIIIthroughVcontrolledsubstances,
asdefinedinArticleIIoftheIllinoisControlledSubstancesAct,andotherpreparations,
including,butnotlimitedto,botanicalandherbalremedies.Thecollaboratingphysicianor
podiatricphysicianmusthaveavalidcurrentIllinoiscontrolledsubstancelicenseandfederal
registrationtodelegateauthoritytoprescribedelegatedcontrolledsubstances.

b)PursuanttoSection6540(d)oftheAct,acollaboratingphysicianmay,butisnotrequiredto,
delegateauthoritytoanadvancedpracticenursetoprescribeanyScheduleIIcontrolled
substancesbyoraldosageortopicalortransdermalapplicationifallthefollowingconditions
apply:

1)ThedelegatedScheduleIIcontrolledsubstanceisspecificallyidentifiedbyeitherbrand
nameorgenericname.ForthepurposesofthisSectiongenericsubstitutionpursuantto
Section25ofthePharmacyPracticeActshallbeallowedunderthisSectionwhennot
prohibitedbyaprescriber'sindicationontheprescriptionthatthepharmacist"maynot
substitute".

2)ThedelegatedScheduleIIcontrolledsubstancesareroutinelyprescribedbythe
collaboratingphysicianorpodiatricphysician.

3)Anyprescriptionmustbelimitedtonomorethana30daysupply,withanycontinuation
authorizedonlyafterpriorapprovalofthecollaboratingphysicianorpodiatricphysician.

4)Theadvancedpracticenursemustdiscusstheconditionofanypatientsforwhoma
controlledsubstanceisprescribedmonthlywiththedelegatingphysicianorpodiatric
physician.

5)TheadvancedpracticenursemeetstheeducationrequirementsofSection303.05ofthe
IllinoisControlledSubstancesAct[720ILCS570].

c)AnAPNwhohasbeengivencontrolledsubstancesprescriptiveauthorityshallberequiredto
obtainanIllinoismidlevelpractitionercontrolledsubstanceslicenseinaccordancewith77Ill.
Adm.Code3100.Thephysicianorpodiatricphysicianshallfileanoticeofdelegationof
prescriptiveauthoritywiththeDivision.Thedelegationofauthorityformshallbesubmittedto
theDivisionpriortotheissuanceofacontrolledsubstancelicense.

d)TheAPNmayonlyprescribeanddispensecontrolledsubstancesthatthecollaboratingphysician
orpodiatricphysicianprescribes.Licenseddentistsmaynotdelegateprescriptiveauthority.

e)Allprescriptionswrittenandsignedbyanadvancedpracticenurseshallindicatethenameofthe
collaboratingphysicianorpodiatricphysician.Thecollaboratingphysician'sorpodiatric
physician'ssignatureisnotrequired.TheAPNnurseshallsignhis/herownname.

f)AnAPNmayreceiveanddispensesamplesperthecollaborativeagreement.

g)Medicationordersshallbereviewedperiodicallybythecollaboratingphysicianorpodiatric
physician.
